MEMORANDUM

Subj: SOLE SOURCE MEMORANDUM TO ACQUIRE IMAGE VISION MODULAR CONSOLES FOR THE EDF CONSOLES (Purchase Request No: 1301020641)

1. Identification of the agency and the contracting activity, and specific identification of the document as a “Limited Source Justification.”

This is a sole source justification. Contracting activity is the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001 (Contracts Department Code 02).

2. Nature and/or description of the action being approved.

This action will award a purchase order, on a sole source basis, to Image Vision Modular Consoles, 1650 Hausman Gin Road, La Grange, TX 78945, to acquire custom built TE Alpha, Bravo, Charlie Chamber and 1 Atmosphere Chamber Consoles.

3. A description of the supplies or services required to meet the agency’s needs (including the estimated value).

The estimated value of this procurement is approximately $121,358.49. The Government's minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This procurement will be funded with 2022 Operation and Maintenance, Navy (OMN) funds.

4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service. 10 U.S.C. 2304(c)(1), 10 U.S.C. 2304(d)(1)(B). Only one responsible source and no other supplies or services will satisfy agency requirements, FAR 6.302-1.

Only one responsible source and no other supplies or services will satisfy agency requirements, FAR 6.302-1. The equipment listed above is manufactured by Image Vision Modular Consoles, and they are the only source for that meet this requirement for the following reasons: NEDU currently owns the custom built Image Vision Modular Consoles in the Ocean Simulation Facility (OSF) Control Room and Medical Deck, and Test Pool. These are the only consoles that will match the existing consoles used at the Chamber Support Operator Station, Dive Watch Supervisor Station, Atmosphere Analysis Operator Station, Control Technician Station Console, and Medical Deck Supervisor/Technician Console, and Test Pool Supervisor/Technician Console.

These are propriety assemblies; other sources do not have the rights, equipment to manufacturer, or provide these listed parts. Other manufacturer’s consoles are not compatible with the established Image Vision Modular Consoles components in use at NEDU. Use of other consoles would not support current TE Alpha, Bravo, Charlie Chamber, and 1 Atmosphere Laboratory equipment, therefore requiring a change from the original configuration which would invalidate certification of equipment. Therefore it is imperative that this critical life support equipment is acquired from Image Vision Modular Consoles.

5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).

The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.

6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.

As stated in paragraph 4 above, the Image Vision Modular Consoles specified are the only source that can meet this requirement or satisfying the government’s needs and the items proposed for procurement meet the commercial item definition. Therefore, no additional market research was conducted because section 4 of this document dictates proprietary modular console design.

7. Any other facts supporting the justification.

None.

8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.

As stated in paragraph 4 above, Image Vision Modular Consoles is the only product that can meet all requirements.
