Justification and Approval (J&A) for Other Than Full and Open Competition

I. Contracting Activity.

II. Nature and/or description of the action being processed.

This individual Justification and Approval (J&A) authorizes use of other than full and open competition procedures to procure 3M Aluminum Tape used by 569AMXS on all weapon systems to protect/seal, keep chemicals/water out of specific areas on parts as well as protect/seal areas during the sand, prime and paint processes.

The resulting New Contract is brand name, requirements type, negotiated action for a commodity.

Commercial Commodity, Contract Type: Firm-Fixed Price (FFP) Estimated Award Date of Contract: 4-6 weeks ARO

III. Description of supplies/services required to meet agency needs.

Aluminum Tape (1", 2", 3" x 60 yds)

76 AMXG / 569 AMXS requires 3M aluminum tape that meets the specifications In Accordance With (IAW) TO 1-1-691. All quantities must meet the following specifications:

Quantities required for FY21 2nd Quarter (requirement based on usage for Paint/De-Paint on aircraft and aircraft parts) -

• 1600 rolls of 1" X 60 yds 3M 425 Tape PN 70008501309

• 1140 rolls of 2" X 60 yds 3M 425 Tape PN 70008500533

• 2496 rolls of 3" X 60 yds 3M 425 Tape PN 70008500541

Specifications applies to all three width size tape rolls listed below.

• Tape must meet SAE-AMS-T-23397 Type II specification.

• Tape backing thickness must be no less than 2.8 mils (0.07mm).

• Total thickness of tape must be no less than 4.6 mils (0.12mm).

• Tape must have a temperature use range from -65F to 300F (-54C to 149C).

• Tape must be recognized by UL to UL 746C and Classified by UL to UL 723, Class "L" for low flammability rating.

• Tape must have dead soft aluminum foil backing to conform to curved and uneven surfaces.

• Tape must have acrylic adhesive but removes cleanly after harsh masking applications.

• Tape must withstand exposure to flame, weathering, moisture and UV.

• Tape must be resistant to chemicals to protect surfaces during de-paint process and other chemical masking operations.

IV. Statutory authority permitting other than full and open competition.

6.302-1 – 10 USC 2304(c)(1), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).

The 3M Brand is mandated In Accordance With (IAW) Technical Order (TO) 1-1-691.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

Market research was performed, but this brand is the only material approved by the Task Order referenced in Section V. Solicitation will be posted to beta.sam.gov.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The contracting officer will ensure that the items described herein are negotiated at a fair and reasonable price to the Government and Contractor. Being a commercial item, Certified Cost and Pricing Data cannot be requested, however, Other than Certified Cost and Pricing Data and redacted invoices of similar Modifications (if available) provided at other installations or places of business will be used for comparison purposes. Price reasonableness will be determined using price analysis IAW FAR 15.404-1(b), and supported by a technical evaluation and analysis by the Subject Matter Expert (SME).

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

Market research was performed reviewing Dynamic Small Business Search and System for Award Management databases using North American Industry Classification System Code 325520 looking for companies that could the item(s) listed above. A review of small businesses to include 8(a), HUBZone, Service Disabled Veteran Owned Business, and Women Owned Small Business was
