DEPARTMENT OF THE NAVY

OFFICE OF NAVAL RESEARCH

875 NORTH RANDOLPH STREET

SUITE 1425

ARLINGTON, VA 22203-1995

JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

Upon the basis of the following justification, I hereby approve the issuance of the contractual action described below:

1. Identification of Agency and Contracting Activity.

Department of the Navy, Office of Naval Research (ONR).

2. Nature/Description of Action.

ONR intends to issue a sole source bridge contract to continue support services currently provided by Strategic Operational Solutions (STOPSO) under task order N00178-09-D-5822-EE02. The bridge will provide public affairs, strategic communications, multimedia and exhibiting support services. The period of performance for the bridge contract is 01 September 2020 through 31 August 2021.

3. Description of Supplies/Services.

The contractor shall provide the required professional level communications for the high-level technical information of naval science and technology. Corporate Strategic Communications (CSC) requires support services for public affairs, strategic communications, and multimedia support. The period of performance for the action is from 01 September 2020 to 31 August 2021 with an estimated value of $2,860,500.11.

4. Identification of Statutory Authority.

The statutory authority permitting other than full and open competition is Title 10 U.S.C. 2304(c) (1), Only one responsible source and no other supplies or services will satisfy agency requirements, as implemented by the Federal Acquisition Regulation (FAR) 6.302-1.

5. Demonstration that Nature of Acquisition Requires Use of Cited Authority.

STOPSO has been successfully performing the support services currently required for this effort under task order N00178-09-D-5822-EE02 since 01 September 2015. The current contract is set to expire 31 August 2020. There is a continuing requirement for these services pending award of a competitively awarded, longer-term task order. STOPSO is the only source that can provide the continuing support services that ONR requires without disrupting ongoing efforts during the bridge period. The Government anticipates awarding the follow-on task order on or before 31 August 2021.

6. Description of Efforts to Ensure Other Potential Sources Were Sought.

Pursuant to FAR 6.302-1(d)(2), a Notice of Intent to Award a Sole Source was posted to https://beta.sam.gov/ on 16 June 2020. As of 25 June 2020, no responses have been received. The notice of intent to Sole Source will close on 02 July 2020.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer shall determine the cost to be fair and reasonable prior to award utilizing proposal analysis techniques described in FAR 15.404.

8. Description of Market Research.

Market research was not conducted for this action, because only the incumbent contractor can successfully provide continuity of services during the bridge period. A Notice of Intent to Award a Sole Source was posted to https://beta.sam.gov/ on 16 June 2020. As of 25 June 2020, no responses have been received. The notice of intent to Sole Source will close on 02 July 2020.

9. Any Other Supporting Facts.

Not applicable.

10. Listing of Interested Sources.

11. Actions Taken to Remove Barriers to Competition.

ONR anticipates a one-year contract bridge will provide sufficient time to release a request for proposals (RFP) and make a competitive award for Code ONR52 for public affairs, strategic communications, multimedia and exhibiting support services. The bridge contract will allow continuous support up to the point of a new contract award.

12. Statement of Delivery Requirements.

The contractor shall provide monthly progress and financial status reports, individual and master travel reports, enterprise contractor manpower reporting application (ECMRA) reports, a quality control plan, a government furnished equipment, government furnished materials, and government furnished information (GFE/GFM/GFI) report, and other reports as described in the statement of work for the bridge contract.

13. Reference to the Approved Acquisition Plan (AP) or Equivalent Documentation. .

A Management and Oversight Process for Acquisition of Services-Streamlined (MOPAS) will be approved no later than 31 August 2020.

14. Explanation of all actions attempted to make the immediate acquisition competitive and the cost/benefit analysis reflecting costs associated with obtaining competition and anticipated benefits.

The requested bridge contract covers only the period-of-performance believed necessary to conduct a competitive procurement for this continuing requirement. No benefit to the Government would be obtained by conducting a competition for the bridge. The follow-on award will cover a five-year period of support for Code ONR52
