MEMORANDUM TO THE FILE – Object Management Group, Inc. (OMG)
Subject: USE OF OTHER THAN FULL AND OPEN COMPETITION FOR AN
ACQUISITION UNDER THE SIMPLIFIED ACQUISITION THRESHOLD
I. BACKGROUND:
1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).
2. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement and the requirement is not expected to exceed the simplified acquisition threshold.
II. DESCRIPTION OF ITEM OR SERVICE:
The Object Management Group (OMG) is an open membership, not-for-profit technology standards and reference organization for model based engineering. OMG offers unique access to industry intelligence and upcoming trends related to model based engineering.
The proposed purchase order will require OMG to provide annual membership to attend symposiums, participate in standards issuing decisions, and use products and services available to members. The membership allows Department of Navy (DON) to identify a participant to attend OMG events (exchangeable among identified individuals within the DON) and possess voting rights for a specified standards body. Membership also advances the training and development of attending and participating personnel.
This membership is required in support of the Department of the Navy’s Modeling & Simulation
Office (NMSO), in order to meet their mission to facilitate commonality via standardization of technological practices, processes, and standards throughout the Naval enterprise and beyond.
The proposed period of performance is one (1) twelve month base period, with four (4) twelve month option periods.

It is anticipated that the membership will cost $12,850 per year. The Navy Modeling &
Simulation Office (NMSO) intends to fully fund the base period of performance with FY23
RDTEN funds.

III. THE DETERMINATION FOR USE OF OTHER THAN FULL AND OPEN
COMPETITION IS BASED ON THE FOLLOWING (select all that apply):

1. ___ RESTRICTIVE RIGHTS. The source has established proprietary rights, limited rights in data, patent rights, copyrights or secret processes in the item or service required.
2. ___ EXCLUSIVE LICENSING AGREEMENTS. The item or service is only available from the Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.
3. X OTHER REASONS. Other reason not identified above. Provide details on mission impact if requirement is not solicited from only one source.
DON objective is to maintain currency with industry methods, approaches and standards in a continuously evolving requirement. To do so, ONR must remain apprised of global industry activities while retaining a position of leadership in the development, refinement, and publishing of standards germane to their platforms and systems, and regarding data interface standards for exchange of information with vendor partners through contractual arrangements.
The Object Management Group (OMG) is an open membership, not-for-profit technology standards and reference organization for model based engineering. These standards are driven by vendors, end-users, academic institutions and government agencies. OMG is unique in offering access to industry intelligence and upcoming trends related to model based engineering. The
Department of Defense and Department of the Air Force have memberships with the Object
Management Group. The Department of the Navy currently has a membership under purchase order N00014-22-P-4002. This membership is set to end with the expiration of N00014-22-P-
4002, on 8/31/2023.
No other vendor sells this membership, like via a 3rd party vendor. OMG sells direct and there is no competitive market for the required service. OMG has a published price sheet where every consumer is advised of the OMG price structure. The fees can be found at https://www.omg.org/memberservices/feestructure.htm.
If this membership is not solicited from this sole source, a cohesive system of model based engineering standards would not be available within the Naval enterprise nor for collaboration with the Joint Forces. A negative impact on schedule, cost, and scope would be realized since it is the mission of the Navy Modeling & Simulation Office (NMSO) to facilitate commonality via standardization of technological practices, processes, and standards throughout the Naval enterprise and beyond.
B. ___ BRAND NAME. Item required must be a brand name product, or feature of a product, particular to one manufacturer.
C. ___UNUSUAL AND COMPELLING URGENCY. The supplies or services are of such unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals.
Urgent requirements are supplies or services that will result in a work stoppage, or are mission critical and the routine processing time would result in injury to the Government. The determination that the procurement for the above item/service is an urgent and compelling requirement is based on the following:
