SINGLE SOURCE JUSTIFICATION (Including Brand Name) (Simplified Acquisition Procedures under FAR Part 13 Not Exceeding $250K)
1. AGENCY / CONTRACTING ACTIVITY: USACE-CESAW

2. DESCRIPTION OF ACTION: Approval to award a brand name firm-fixed-price requirement. The
Contractor shall furnish all labor, equipment, materials, and services to provide the U.S. Army Corps of Engineers (USACOE), Wilmington District’s Survey Vessel Swart with services to Refurbish (2)
Caterpillar C18 engines.
Nature: New Requirement Follow-on Requirement
Mod to Existing Purchase Order/Contract Number
Pricing: Firm-Fixed Price Time & Materials Cost
3. DESCRIPTION OF SERVICES OR SUPPLIES: The U.S. Army Corps of Engineers, Wilmington
District has a need to refurbish (2) Caterpillar C18 engines cylinder heads and install remanufactured cylinder heads and remanufactured injectors on Caterpillar C18 engines, and paint (to include replacing Data plates, if necessary), inspect, and test: Serial #’s T2P01535/T2P01463. The
Government will be responsible for delivery and return of the SWART; the vessel’s captain will navigate to the contractor’s work site as well as navigate the return to the USACE, Wilmington
District’s Wilmington Marine Center. Work shall be completed within fourteen days (14) after award of contract. Full requirement listed below:
a. Contractor shall furnish all labor, materials, supplies, equipment, and services
b. Services shall be performed by Caterpillar Trained/Certified Marine Diesel Power
Technician(s), using remanufactured CATERPILLAR brand parts.
4. AUTHORITY CITED: FAR 13.106-1(b)(1)
FAR 13.106-1(b)(1)(i): For purchases not exceeding the simplified acquisition threshold
(SAT), contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g. urgency, exclusive licensing agreements, brand name, or industrial mobilization)
5. REASONS FOR AUTHORITY CITED:
The Survey Vessel SWART works and travels the entire east coast of the United States to perform dredging hydrographic surveying operations. It is imperative to maintain the aforementioned engines to the best of our capability to mitigate the risks associated with engine failure. Mechanical failure of these engines could cause extensive vessel and/or property damage, and/or injury, and/or loss of life.

IAW 13.106-3 (a)(2)(vi) - Comparison to an independent Government estimate.

Based on the foregoing, I approve this sole source justification subject to availability of funds, and provided that the services and supplies herein described have otherwise been authorized for acquisition.
