About this file

This is a Single Source Justification form (FWS Form 3-0034) submitted by the U.S. Fish and Wildlife Service's Joint Administrative Operations for a sole source acquisition under the Simplified Acquisition Threshold (SAT).

The acquisition concerns a research project assessing the stocking of Lahontan cutthroat trout in Lake Tahoe, requiring surgically implanted acoustic transmitters that sense predation events through a stomach acid-induced switch while transmitting water temperature data. Market research confirms that only Innovasea produces acoustic transmitters with predation-sensing capabilities, and the stomach acid-induced switch is patented technology with no competing products available. The contractor, Innovasea, has demonstrated qualifications through three years of successful use in the ongoing study with on-time delivery and proper equipment functionality. The cost is determined fair and reasonable based on previous years of acquisition and market research on acoustic transmitters, with any cost increase attributable to recent inflation. Program Officer Roger Peka certified the justification on March 14, 2025, and Contracting Officer John Skogen approved the sole source acquisition procedures under FAR Part 13 on March 3, 2026.

1. Description of Need

3. Other Capable Sources

2. Market Research Conducted

Pursuant to FAR subpart 13.106-1(b)(1)(i) and (ii), for purchases not exceeding the Simplified Acquisition Threshold (SAT), Contracting Officers may solicit from only one source if the circumstances deem only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).

Instructions: The information in the text boxes are provided as sample language or to indicate a needed fill-in. Sample language should be removed from the final document. All text boxes require information and shall not be left blank.

Based on the above justification, I hereby certify and approve the use of sole source acquisition procedures under FAR Part 13 for this purchase.

Contracting Officer

Text3: There are no other sources capable of producing acoustic transmitters that sense predation events. The stomach acid induced switch is patented technology, and no other companies produce a transmitter that has the same capabilities.
Text2: Scientific literature has been reviewed that includes a number of acoustic telemetry studies. While several companies produce acoustic transmitters for tracking fish, only Innovasea produces acoustic transmitters that detect when fish predation occurs. Internet searches and attendance of trade shows at scientific conferences confirm this.
Text1: A research project for assessing stocking of Lahontan cutthroat trout in Lake Tahoe relies on understanding predation rates from non-native trout vary according to stocking locations, stocked fish size, and thermal preferences/tolerances. The only way to study this is through the use of surgically implanted acoustic transmitters that sense predation events through a stomach acid induced switch, while also transmitting water temperature data. This is an ongoing study, and the two previous years of research demonstrate the effectiveness and efficiency of the technology in a large lake environment.
Text4: As stated in box 3, the stomach acid induced switch is patented technology, and no other companies produce a transmitter that has the same capabilities. Until the patent expires or another technology is developed, this equipment is the only way to study predation events within Lake Tahoe.
Text6: The cost is fair and reasonable based on previous years of acquisition, and marked research on acoustic transmitters that lack the predation sensing switch. The slight increase in cost per transmitter this year is within reason based on recent inflation of costs for goods and services.

Text5: Innovasea has produced these predation sensing acoustic transmitters several years, and we have used them for three previous years of the ongoing study. The equipment has been delivered on time and functioned as advertised.
