About this file
This document is a single source justification for the acquisition of 48 Marisource vertical incubator 16 tray systems by Coleman National Fish Hatchery. The hatchery requires the equipment on an urgent basis to increase capacity for collecting fall run Chinook salmon eggs before the October 15th start of the run. The systems must be compatible in dimensions and capacity with the hatchery's existing 178 Marisource units. Legends Brand is identified as the sole American manufacturer of the units. No other vendors can provide a compatible system without completely overhauling the hatchery's equipment. The contracting officer anticipates the price will be determined fair and reasonable based on negotiations and market research to be conducted prior to award. The solicitation number is 140FS123P0245 and is being conducted by the Department of the Interior Fish and Wildlife Service as a limited source justification.

| Text3: Alll other vendors are third party distributors of Mariource vertical incubator 16 tray systems. This purchase will be made under Simplified Acquisition Procedures and Other Than Full and Open Competitions IAW FAR 13.501(a)(1) and authorized by FAR 6.302-1(a)(2)(ii)(A) Supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development or production of a major system or highly specialized equipment, including major components thereof, when it is likely that award to any other source would result in -- substantial duplication of cost to the Government that is not expected to be covered through competition. |
| Text2: Market research shows that there will be no adequate available competition for small businesses in this market. Legend Brands Inc. is the sole manufacturer and distributor of Marisource vertical incubator 16 tray systems in the United States. The hatchery already has 178 Marisource vertical incubator 16 tray systems so having the same equipment would make installation, ordering replacement parts, and making repairs very efficient. Any upgrades from another manufacturer will not be compatible and have not been tested and therefore, requires an entire overhaul of the system and the unit used at Coleman National Fish Hatchery. |
| Text1: Coleman National Fish Hatchery is needing to urgently purchase forty eight (48) Marisource vertical incubator 16 tray systems to increase the hatchery's capacity of collecting fall run Chinook salmon. Dimensions of the equipment needed is: 69 inches in height by 23.75 inches wide by 25 inches deep. In addition the equipment needs to be rated for salmon eggs and hold at least 10,000 salmon eggs in each tray. Trays are required to increase the hatchery's capacity of collecting fall run Chinook salmon for the upcoming season. The equipment needs to arrive before October 15th so hatchery staff can have a few days to install the equipment and connect it to the water supply. The fall Chinook salmon run will start in early October and run through early November. |
Any delays could jeopardize the Service's ability to not raise additional fall Chinook salmon eggs which are vital to the ecosystem and operations.
| Text4: Legends Brand is the sole American manufacturer and distributor of Marisource vertical incubator 16 tray systems and holds rights on the product in the United States. | |
| Text6: The contracting officer anticipates that the price will be fair and reasonable based off negotiations, price analysis and market research to be conducted upon receipt of a quote and prior to award. | |
