JUSTIFICATION & APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION
for SIMPLIFIED ACQUISITIONS OVER THE MICROPURCHASE THRESHOLD (See FAR
Part 2) UP TO SAT (See FAR 13.106-1)

1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost):
This bobcat skid steer will be used at Cuyahoga Valley National park to support maintenance and Resource Management needs to maintain the park operations. The skid will have different bucket, drum mulcher, forks, asphalt milling attachments to support our ongoing maintenance operations. The drum mulcher will be used to remove evasive plants for Resource Management. Other attachments will support road maintenance, trails, and grounds maintenance. Total estimated cost is about $175,000.00

Explain: This PMIS 188470 project is to replace our 1999 Melroe 773 Skid Steer Loader with a Bobcat T86 Track Loader. The reasoning for only a Bobcat and no other brand of skid steer is that we have 3 other Bobcat skid steers that are being used in the park. We also have many other attachments that these machine use. Some of the attachment take electrical wires to hook up to the machine. These electrical wires only work on Bobcat Equipment and are not universally exchangeable with other brands of skid steer loaders. Also, the hydraulic couplers are not universal across different brands as well. We would have to see if the new brand of skid steer can be upfitted with Bobcat hydraulic fittings so our attachments would work on that different brand of skid steer.
If we had to go with a different brand, then we would need to double our attachments and that would increase the cost and maintenance needs on all the other attachments. In the best interest of the Government, it will be best to stay with Bobcat Skid Steers so that all the attachments will universally fit across all of our bobcat skid steers.
Additionally, based on the below market research there is no expectation that any Large or Small Business other than Doosan Bobcat North America, Inc would be able to provide the required product or offer a competitive rate since Doosan Bobcat North America, Inc offers a 30% reduction in pricing which no local authorized dealer is able to provide or match.
3. Market Research. Please explain the results or why one was not performed. State whether any other offers were received or anyone expressed interest:
1. A search was conducted on GSA eBuy, however no Bobcat products could be identified.
2. Prior contracts were also researched to determine potential vendors. While prior contracts exist for Skid Loaders, none could be identified that were for a Bobcat. Prior vendors in these contracts were contacted by phone, but they stated they do not provide Bobcat Skid Loader and that Bobcat limits the ability of outside vendors to provide Bobcat products.
3. An online search of authorized Bobcat dealers on the Bobcat website was also conducted, however most authorized dealers in the local area weren’t registered in SAM.gov.
4. Of the authorized Bobcat dealers listed on their website, several authorized dealers were contacted by phone.
Bobcat Enterprises, located in Butler County Ohio, was identified as being registered as a Small Business in SAM.gov. However, when contacted by phone they stated that they were not contractually authorized by Bobcat to do business in Cuyahoga County Ohio, and further stated that Bobcat contractually obligates authorized dealers only to operate in certain geographic areas. They suggested contacting Leppo Inc located in Kent Ohio, who is authorized by Bobcat to do business in the area
Leppo Inc is registered as a Small Business in SAM.gov and was contacted by phone regarding this requirement. They stated that all federal sales for Bobcat products are contractually required to go through the Bobcat national office, which is registered as a Large Business under Doosan Bobcat North America, Inc. Additionally, they stated that Doosan Bobcat North America, Inc offers approximately a 30% discount for federal sales which local offices are unable to offer or match. They also stated that all federal sales awarded through Doosan Bobcat North America ultimately go through the local office after being Awarded, with the local office being provided a commission for doing so.
5. Based on the above market research, there is no reasonable expectation that any other Small or Large Business would be able to provide the required product, or that their quote would be justifiable due to the significant discount for federal sales offered by Doosan Bobcat North America, Inc. All small businesses identified on the Bobcat website as authorized dealers and which are registered on SAM.gov that were contacted stated that contractually, they are only authorized to service specific geographic areas, that they are not permitted to do federal sales, and that they are unable to offer or match the significant federal sales discount offered by Doosan Bobcat North America.
