SINGLE SOURCE DETERMINATION USING

SIMPLIFIED ACQUISITION PROCEDURES (SAP) UNDER THE

SIMPLIFIED ACQUISITION THRESHOLD (SAT)

1. Contracting activity/agency.

Department of the Interior, Interior Business Center, Acquisition Services Directorate, on behalf of Office of Facilities and Administrative Services (OFAS), Library.

2. Description of supplies or services required to meet agency needs.

The sole source acquisition is proposed to procure the Department of the Interior IP address authenticated access to the William S. Hein & Company’s HeinOnline online database.

3. Identification of the single source to be solicited.

The Department of the Interior Library identified a need for DOI employees to have access to an online subscription database providing digitized, searchable, full-text access to federal administrative materials such as the Decisions of the Department of the Interior, Annual Reports of the Commissioner of Indian Affairs, Congresssional Record, Federal Register, Code of Federal Regulations, United States (Supreme Court) Reports, United States Code, the United States Statutes at Large as well as articles from reputable law reviews and state administrative materials dating back to their inceptions. HeinOnline is the world’s largest image-based legal research collection and contains more than nine centuries of legal history. All content is image-based in PDF format just as they appear in the original print copy thus preserving the authenticity of the hard copy in a digital environment.

HeinOnline provides Departmental employees with digitized, searchable, full-text access to all of the materials mentioned above from the inception of these publications to date. The publications provided on HeinOnline are used to assist them in reviewing historic regulations, policy, procedures, and caselaw in order to formulate new policy and legislation and for use in current litigation involving the Department.

These unique product collections, whose titles, ranges and scopes are not found in any other single online database, include the following:

Law Journal Library

The Law Journal Library features comprehensive full-text access to over 3,000 law and law-related periodicals. Coverage is from the first issue published for all periodicals and goes through the most-currently published issues allowed based on contracts with publishers. More than three centuries of searchable legal periodical research is available. This Library is divided into subsets that allow the user to search the entire library by article title, author, subject, state or country published, full text, and narrow by date.

American Association of Law Libraries

This collection includes AALL publications such as AALL Spectrum, American Association of Law Libraries Newsletter, American Association of Law Libraries President's Newsletter, Index to Legal Periodicals and Law Library Journal, Law Library Journal, Publications Clearing House Bulletin, and Technical Services Law Librarian.

Indigenous Peoples of the Americas: History, Culture & Law Collection

With nearly 4,000 titles unique to this collection and more than 2.3 million total pages dedicated to American Indian Law, this library includes an expansive archive of treaties, federal statutes and regulations, federal case law, tribal codes, constitutions, and jurisprudence. This library also features rare compilations edited by Felix S.

Cohen that are only accessible online through HeinOnline.

Federal Register Library

The Federal Register Library is updated on a daily basis. Its coverage is comprehensive and begins from its inception (1936). It also includes the CFR from inception (1938), Official US Bulletin (1917-1919), United States Government Manual from inception (1935), Daily and Weekly Compilation of Presidential Documents from inception (1965).

Legal Classics Library

Includes thousands of works from some of the greatest legal minds in history including Joseph Story, Jeremy Bentham, William Blackstone, William Holdsworth, Henry Maine, Federick William Maitland, Frederick Pollock, and Benjamin E.

Cardozo. In addition to many classic treatises, this collection also includes rare items that are found in only a handful of libraries around the world.

Session Laws Library

This library contains the session laws of all 50 U.S. states as well as Canada, Australia, Puerto Rico, Virgin Islands, and the D.C. Register. All states are current within 60 days of the printed publication, and all states are available back to inception.

State Statutes: An Historical Archive

State Statutes: A Historical Archive includes superseded state statutes for all fifty states. Statues are searchable by state, date, description and text. Coverage goes back to 1717.

United States Code

This collection includes complete coverage of the United States Code dating back to inception in 1925-1926. It also includes the Early Federal Laws Collection, which represents the most complete collection of federal statute compilations prior to the U.S. Code.

U.S. Congressional Documents

This collection features the complete Congressional Record Bound version, as well as the daily version back to 1980. It also includes the three predecessor titles: Annals of Congress (1789-1824), Register of Debates (1824-1837) Congressional Globe (1833-1873), and Congressional Hearings (1927-2015), as well as other important congressional material. Using the Daily-to-Bound Locator Tool, you can quickly find a page in the Bound volume from the Daily edition.

All are full-text searchable back to their inceptions.

U.S. Federal Agency Documents, Decisions and Appeals

This Library, which features reports, decisions, and records; is a complete collection of the official case law of some of the United States' most important U.S. Federal Agencies. Interior Department materials in this collection include:

• Circulars and Regulations of the General Land Office with Reference Tables and

Index

• Decisions of the Department of the Interior

• Decisions of the Interior Board of Land Appeals

Other agencies represented include the Federal Communications Commission (FCC), the National Labor Relations Board (NLRB), and the Securities and Exchange Commission (SEC). This library also includes more than 65 GPO best-selling legal titles. Everything is searchable back to the inception of the publication.

U.S. Federal Legislative History Library

In addition to the inclusion of over 2,500 comprehensive federal legislative histories published by the U.S. GPO and private publishers, this library also includes a unique finding aid based on Nancy Johnson's award-winning work, Sources of Compiled Legislative Histories. This finding aid, often includes references to law review articles on-point to a particular legislative history.

U.S. Presidential Library

The U.S. Presidential Library includes fully searchable access to such titles as Messages and Papers of the Presidents, Public Papers of the Presidents, CFR Title 3 (Presidents), Daily and Weekly Compilation of Presidential Documents, and other documents related to U.S. Presidents, back to the inception of each of these titles.

U.S. Statutes at Large

The collection includes complete, full-text searchable coverage of the Statutes at Large dating back to its inception in 1789, and features multiple browsing and searching options to enhance the online value over the paper volumes.

U.S. Supreme Court Library

This library offers complete fully searchable coverage of the official bound volumes of the U.S. Reports as well as preliminary prints, slip opinions, and books and periodicals related to the U.S. Supreme Court are included in this library.

U.S. Treaties and Agreements Library

This library includes all U.S. treaties, whether currently in-force, expired, or not-yet officially published. This is the world's largest and most complete online collection of U.S. treaties and agreements and includes such prominent collections as the United States Treaties and Other International Agreements set (commonly referred to as the "Blue set"), as well as famous sets from Bevans, Miller, Malloy and others.

4. Reason for authority cited. The contracting officer has determined the circumstances of the contract deem only one source reasonably available.

□ Urgency – The nature of the requirement has been deemed urgent and following competitive procedures would result in unacceptable delays.

□ Exclusive Licensing Agreement X Brand Name – The particular brand name is essential to the requirement and market research indicates similar products do not meet or cannot be modified to meet agency needs. If the justification is to cover only the portion of the buy which is brand name, then it should so state; the approval level requirements will then only apply to that portion.

□ Industrial Mobilization

5. Rationale.

HeinOnline is the only database known to provide fully searchable access to digitized copies of the state and federally produced administrative materials mentioned above dating back to their inception. They are the only known provider of searchable, full text access to digitized copies of the Decisions of the Department of the Interior and the Annual Reports of the Commissioner of Indian Affairs back to their inceptions.

Additionally, they are also the only provider of online access to law review articles dating back to the inception of each law review in their database.

6. Market Research.

Market Research was performed amongst a number of other online database providers to identify if any alternatives existed to make this need available for competition. No alternatives were identified.

Under the authority of FAR 13.106-1(b)(1), the undersigned hereby determines the circumstances of this contract action deem only one source is reasonably available as supported herein.
