About this file
This document is a Single Source Justification under the Simplified Acquisition Threshold (SAT) for the replacement of an intake screen at the WA Warm Springs National Fish Hatchery. The existing 8-foot, 54-inch diameter screen needs to be replaced with an identical custom-made screen to meet hatchery and NOAA-NMFS specifications. Market research conducted found that the original manufacturer, Johnson Screens, is the only qualified source due to the proprietary and patented nature of the screen design. The justification cites the need to maintain the required flow rate and prevent harm to the fish population. The contracting officer has determined the price is fair and reasonable based on prior similar purchases. This sole source acquisition will be awarded under Contract 140FS124P0201 for an unknown amount.

Pursuant to FAR subpart 13.106-1(b)(1)(i) and (ii), for purchases not exceeding the Simplified Acquisition Threshold (SAT), Contracting Officers may solicit from only one source if the circumstances deem only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).

Text3: (Describe the actions taken to locate other capable sources or brands. List any sources that expressed in writing an interest in the procurement.)
None found as this screen has been custom made to meet the hatchery and NOAA-NMFS requirements.
Text2: (Describe the market research conducted or a statement of the reasons market research was not conducted.)
We have researched other options for the intake, including contacting the screen shop for ODFW. After thorough investigation and consultation with experts, we concluded that due to the custom-made nature of the screen and the proprietary information and patents involved, it is crucial to replace it with the same screen setup. This setup has performed well until the recent failure, which will be addressed to prevent another catastrophic incident. The original and recommended manufacture is Johnson screens.
| Text1: Replace the intake screen, currently measuring 8 feet in length and 54 inches in diameter, with a new screen of the same design. This replacement will meet both hatchery and NOAA-NMFS specifications while fitting the current chamber dimensions. The new screen will ensure proper flow, preventing small fish, including smolt-sized fish and other aquatic organisms, from being trapped against it. The specified size and surface area are necessary to maintain the required flow rate and prevent harm to the fish population in the river. |
| Text4: (Describe the actions taken to overcome barriers to competition for any subsequent acquisitions.) |
The barriers for the competition include the inability of others to meet the timeline and budget required to design and fabricate a new screen.
| Text6: Price for the patented, proprietary, and custom-made nature of this hatchery accessory has been determined to be fair and reasonable based on the contracting officer's experience purchasing similar items as a government contract specialist. | |
