BRAND NAME JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY

USING SIMPLIFIED ACQUISITION PROCEDURES (SAP) UNDER THE

SIMPLIFIED ACQUISITION THRESHOLD (SAT)

1. Contracting activity/agency. Department of the Interior, Interior Business Center, Acquisition Services Directorate, Division 3 Branch 1 on behalf of The Defense Intelligence Agency (DIA), Directorate for Science & Technology(S&T), Advanced Technologies Intelligence (ATI)

2. Description of supplies or services required to meet agency needs.

ATI requires a Thermo Scientific Niton XL5 plus XRF Analyzer,

All Authorized resellers of Thermo Scientific Portable Analytical Instruments Inc can submit quotes

4. Rationale. Identification of the exception to fair opportunity and the supporting rationale, including a demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the exception cited. If the contracting officer uses the logical follow-on exception, the rationale shall describe why the relationship between the initial order and the follow-on is logical (e.g., in terms of scope, period of performance, or value).

Per FAR 13.5 were used in accordance with 41 U.S.C. 1901; The contracting officer must justify restricting consideration to an item peculiar to one manufacturer (e.g., a particular brand-name, product, or a feature of a product that is peculiar to one manufacturer).

ATI currently uses the Thermo Scientific Niton XL5 plus XRF Analyzer, to support their chemical and material exploitation mission. ATI rely on the Thermo Scientific Niton XL5 Plus analyzer for more than just low detection limits. It generates fast results and offers great versatility such as the ability to scan a broad range of materials with a single analyzer. ATI’s stateside and overseas teams are trained to operate the Thermo Scientific Niton XL5 Plus handheld XRF Analyzer; acquiring the same brand and model handheld analyzer will allow the program to keep its operating procedures and documentation in place and will prevent the need for ATI staff to retrain on different equipment ATI requires Thermo Scientific Niton XL5 plus XRF Analyzer, to support their chemical and material exploitation mission system that will fit into the agency’s current operating procedures. The Thermo Scientific Niton XL5 Plus is a handheld XRF Analyzer used to access hard to maneuver work spaces. The analyzer can be used for multiple applications such as identification of pure metals and alloys, detection of tramp elements, and geochemical data. or is a person worn chemical warfare agent identifier and toxic industrial chemical detector The Analyzer must into ATI’s current standard operating procedures for chemical and materials analysis

5. Market Research.

The Thermo Scientific Niton XL5 plus XRF Analyzer required are not available through the mandatory sources specified in FAR Parts 8.002 and 8.003. Unicor and AbilityOne do not offer this product.

GSA Schedules do not offer this product either.

NASA SEWP was searched and they do not offer this product and work mainly with the NAICS code 541519.

An SBA quick search was performed using the NAICS code 334519 Limited to the state of Virginia which showed that there are 139 small businesses in the state able to provide the Products needed by DIA ATI.

Thermo Scientific Portable Analytical Instruments, Inc confirmed they have authorized resellers.

This is a commercial item and is available to the public, this acquisition will be 100% Total Small Business Set Aside.

Under the authority of FAR 13.106-1(b)(1), the undersigned hereby determines the circumstances of this contract action deem the brand name is justified and supported herein.
