Statement of Work Seed Application – 2020 Fuels and ESR Treatments Battle Mountain District Office Bureau of Land Management

1.0 Description of Project

1.1 Introduction/Description of Work: The Bureau of Land Management is acquiring seeding on selected sites administered by the Battle Mountain District (see attached map). The work consists of applying seed in 8 units all in different locations for post-fire restoration purposes and both pre and post fuels treatments on BLM administered lands. The work shall consist of application of government furnished seed with contractor furnished equipment. The project areas are defined in attached maps and discussed in table 1. The terrain is steep, and most of it is inaccessible with any form of ground equipment. Also due to lack of cultural clearance, no ground disturbance is permitted with this contract. The Treatment area will not be awarded to multiple vendors. The contractor is not to treat areas outside of identified work areas.

2.0 General Information

2.1 Site tour: Interested parties are urged and expected to inspect the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost of contract performance, to the extent that the information is reasonably obtainable. In no event shall failure to inspect the site constitute grounds for a claim after contract award. Inquiries about project location are welcome, and maps to assist in site visits are available at the Battle Mountain District, 50 Bastian Road, Battle Mountain, NV.

2.2 Base of Operation: The Contractor shall provide such operation facilities as may be required for competent performance of contract. Use of any operation area shall be arranged by and at the discretion and risk of the Contractor, and the Government shall not be held responsible for any loss, mishap, or accident due to conditions of any operating facility used. The Contractor shall provide appropriate warning signs for traffic if roads are used as operating sites. Contractor will return sites to pre-use condition.

2.3 Contractor: Designated area shall be seeded in conformance with these specifications and this Statement of Work. Unless otherwise specified, the Contractor shall furnish at work sites all equipment, labor, supplies, and materials required to complete the job. The Contractor shall be responsible for service and repair of equipment as necessary to continually maintain satisfactory work progress.

2.4 Seed: Seed will be furnished by the Government at the location(s) agreed upon during the pre-work conference. The location of the seed must be agreed upon with 7 days minimum between when the location is decided upon by the contractor and the Government representative and when the seeding will take place. The Contractor shall be responsible to protect seed from loss or damage. Seed damaged or lost while in the custody of the Contractor shall be replaced by the Contractor at no additional expense to the Government. The Contractor must inform the Government representative within 5 days of the seeding being done so that any remaining seed and government equipment can be removed from the site.

2.5 Seed Application: The Contractor must be able to evenly distribute the designated seed at the rates specified in this Statement of Work. Equipment that cannot perform the specified work shall be modified or replaced by the Contractor within two calendar days. Application equipment shall be equipped for carrying seed with distribution mechanism including release, shutoff, and spreading device which can be calibrated for spreading seed at the prescribed rate in an acceptable manner and uniform pattern. Seed application equipment shall include physical measures to prevent seed from blowing out.

2.6 Seeder Calibration: The Contractor shall calibrate seeding equipment prior to application on the project. The Government will supply seed for calibration. However, the seed may not be available until approximately two days prior to the approximate start date of the project. Seed not used for calibration shall be recovered for use on the project.

2.7 Quality Control and Monitoring Equipment: The Contractor shall furnish equipment to monitor and ensure evenly spaced, straight, regular, and complete coverage of all areas included in the seeding job. The contractor is responsible for making sure that the correct seeding rate is utilized and that there is quality control in place to make sure that on the ground coverage is complete and accurate.

2.8 Work Crew: All Crew for operation of equipment and seed handling and loading shall be furnished by the Contractor.

2.9 The period of performance is from September 15, 2020 after the first wetting rain/snow event, and will be completed no later than December 15, 2020 (depending on weather and soil conditions). Government preference is for application immediately prior to wetting rain/snow event.

2.10 The Contractor shall begin work within 7 calendar days of the date agreed upon in the prework conference. The Contractor shall continue performance of the work under the contract without delay or interruption except by causes beyond his control as defined by contract clauses, or by the receipt of a “Suspend Work Order” issued by the Government. Failure to do so may be cause for action under the “Default” clause. The Contractor shall complete all work required within the time specified.

3.3 Application Conditions: Seed shall not be applied when the wind speed exceeds ten miles per hour.

3.4 Coverage: The entire surface within the designated boundaries of the job area shall receive uniform coverage with the seed. Seeding strips shall be patterned in such a manner as to secure as high a uniformity of seed distribution. Such distribution shall not vary more than 15 percent above or below the average distribution of seed per unit of surface specified for the particular area concerned. Inspection will be made as operations progress to determine uniformity of application. The Contractor is required to show how they will do quality control and on the ground inspections while seeding. Any areas missed by the Contractor or seeded to less than the concentration specified shall be re-seeded and brought up to standard, or by suitable deduction from contract price, at the option of the Government. No additional cost to the Government will be incurred.

3.5 Seed openings of the distribution mechanism shall be inspected at sufficient intervals by the contractor to insure proper functioning and even distribution of seed. If at any time inspection of equipment reveals that seed openings are not properly operating or that feeders are blocked, the COR may require reseeding of that portion of the area or areas if the Government determines it was not properly seeded, at no additional cost to the Government.

3.6 Tests for Uniformity and Rate of Application: Both the Contractor and the Government will conduct tests as operations progress to determine uniformity of seeding. Contractor is required to provide to the Government how they will be determining uniformity of seeding and all records of what was determined during implementation.

3.7 Work Stoppages: The Government reserves the right to stop seeding operations at any time when seeding conditions are considered sufficiently unfavorable to warrant stoppage. Stoppage shall continue until seeding operations are again authorized by the Government. No monetary compensation will be given to the Contractor for work suspensions.

3.8 Completion of Contract: The contract will be considered completed, and payment due when all seed furnished to the Contractor by the Government has been seeded to the standards specified above; or when all areas designated under the contract have been seeded to specifications; or if performance under the contract is ordered to be terminated by the Government; and when the Contractor has furnished the Government with the Shapefiles and Printouts.

3.9 Environmental Consideration: The project site shall be cleaned up to pre-use condition, and all refuse shall be removed and disposed of at an approved landfill.

The plan should include names and emergency phone numbers for personnel and facilities to contact, including Flight for Life/ Life Flight/ Care Flight, etc., in case an emergency warrants such actions. The plan should also include a description of on-site emergency procedures to follow in case of an accident. The plan should identify the insurance company providing coverage and the pertinent group coverage number.

4.2.1.1 It is the responsibility of the Contractor to identify all hazards within the work area. All appropriate precautions shall be taken by the Contractor.

The equitable adjustment shall be based upon any increase or decrease in costs due solely to the variation above 115% or below 85% of the estimated quantity. If the quantity variation is such as to cause an increase in the time necessary for the completion of the project, the contractor may request, in writing, an extension of time, to be received by the Contracting Officer within 10 days from the beginning of the delay, or within such further period as may be granted by the Contracting Officer before the date of final settlement of the contract.
