2. Description of Action: The proposed action is to request approval for a Firm-Fixed-Priced contract for the procurement of Commercial Off-the-Shelf (COTS) Oracle Java Standard Edition (SE) Support for a quantity of 960 units. The Customer Support Identifier (CSI) for this requirement is 19280043 and the Support Service Number is 6031347. The NAICS Code is 511210. The requirement for this effort is not available under CHESS ESI. This requirement will support the Global Command and Control System-Army (GCCS-A). This effort is for a one (1) year software support with an estimated total value of $254,620.80. FY2016 Operation and Maintenance Army (OMA) funds will be used for this effort. An acquisition plan was not required since the procurement did not meet the threshold at Defense Federal Acquisition Regulation Supplement (DFARS) 207.103(d)(i)(B).
3. Description of Supplies/Services: Global Command and Control System-Army (GCCS-A) is the Army’s strategic, theater, and tactical command and control system. The Global Command and Control System (GCCS) supports the Department of Defense’s (DoD) Mission Need Statement for the Horizontal Integration of Battle Command (HIBC), also known as Battlefield Digitization, dated 10 January 1995. These systems are part of the Army’s answer to the HIBC’s need to meet Command, Control, Communications, Computers, and Intelligence requirements for the Warrior objectives set forth by the Joint Staff in June 1993 by providing capabilities that support the Warrior’s need for a fused, real-time, true picture of the battle space. GCCS–A is the Army component of the GCCS-Family of Systems (FoS). GCCS FoS modernization will be the DoD Joint Command and Control (JC2) System of Record. The GCCS FoS is made up of the GCCS-Joint (GCCS-J), GCCS-Army (GCCS-A), GCCS-Maritime (GCCS-M), and GCCS-Air Force (GCCS-AF). Together, these systems interoperate with a variety of other systems to provide critical Joint and Service warfighting Command and Control (C2) capabilities such as situational awareness, force planning, and force protection capabilities. The GCCS-A provides the sole link between strategic Joint and Army commanders and Army Support Component Command (ASCC) theater Army commanders to Corps and below.
Java SE Support allows you to develop and deploy Java applications on desktops and servers, as well as in embedded environments. Java offers the rich user interface, performance, versatility, portability, and security that GCCS-A and GCCS-J applications require. Java SE Support offers Standard Oracle support for Java SE 24 hours/7days a week, direct access to updates from My Oracle Support (MOS), and updates for end-of-life (EOL) versions of Java SE. The Java Platform, Standard Edition (Java SE) is currently shipping from Oracle in the form of the Java Development Kit (JDK), and Java Runtime Environment (JRE). GCCS-A is currently running Java JRE in its fielded baselines.

5. Reason for Authority Cited: Oracle, 500 Oracle Parkway, Redwood City, CA 94065 is the developer / manufacturer of the Java SE software and maintenance service and states it is proprietary. The use of a brand name description in this acquisition is essential to GCCS-A, thereby precluding consideration of a product manufactured by another company. GCCS-A software requires Oracle Java to run GCCS-A and GCCS-J applications. Oracle Java is the only software to be declared and approved by the DISA under the current Authority To Operate (ATO). GCCS-A software integrates the GCCS-J applications and infrastructure components when developing Army specific applications. GCCS-A applications are developed using the Java and JavaScript software languages, which are COTS programming languages. Oracle Java SE remains the only software product that meets those requirements mandated by the current GCCS-J architecture managed by DISA. The Java SE support enables us to receive critical security fixes, critical patch updates, upgrades, and technical assistance.
The GCCS-A software integrates GCCS-Joint software applications and infrastructure components in addition to Army-developed applications to perform Army specific functions. Java SE is an integral component of the GCCS-A software baseline that has been tested and approved for an ATO in order to maintain interoperability with the GCCS-J, COCOMs and Coalition Forces. Chief Information Officer (CIO)/G6 memorandum, dated 5 August 2011 and 4 January 2013 requires that once a system is certified as Army Interoperable it is under CIO/G-6 configuration management and as such no unilateral changes will be made to the GCCS-A software. CIO/G6 memorandum dated 4 February 2013 has certified the current GCCS-A software in the authorized interoperability baseline with a 3 January 2017 Certified Expiration Date. For this action, Software Engineering Center’s Command, Control-Tactical (C3T) Directorate requires the Java brand name software which is peculiar to Oracle. To date, no other COTS software product can meet the Joint and DISA community requirements without risking Joint interoperability. The current version of the GCCS-A software that is being fielded incorporates Oracle Java variant. It has been tested and approved for release to Army units authorized to use the GCCS-A systems. The required Java software application and out year maintenance is unique, highly specialized, and essential to satisfying the Army’s requirements. The GCCS-A requirement for Java software and maintenance can only be satisfied by Oracle America’s JAVA SE license and support service as they are proprietary to Oracle America.
Failure to secure this product support will prohibit the maintenance/sustainability of fielded GCCS-A systems which in turn will prevent Army units from performing their function/mission which is to provide the Joint Commanders a real-time total Army picture of the battlefield needed to command, control and coordinate forces as well as provide the tactical Army Commanders with critical strategic, theater, or multinational situational awareness information essential for their planning and decision making on the battlefield. Without GCCS-A, the Army would be not be able to locate the other services or multinational forces on the battlefield. This would put the Army soldiers in harm’s way as all the battlefield forces would not be able to locate the United States Army units. Moreover, the success of the Army’s mission would be jeopardized which could potentially result in serious injury or loss of life to the Warfighter and other Coalition Forces.
6. Efforts to Obtain Competition: Members of the Software Engineering Center (SEC) Centralized Acquisition and License Management (CALM) Team conducted market research - details of which are outlined in paragraph 8.
7. Actions to Increase Competition: Commercial software developer / manufacturers are encouraged to increase the number of authorized resellers. Additionally, upon receipt of the requirement a list of authorized distributors for this software was immediately requested from the original developer / manufacturer. The manufacturer will be encouraged to pursue distribution of their products/services through Small Businesses, HUBZONE, Service Disabled Veteran Owned, and Woman Owned Small businesses. Market research will be conducted annually on the baseline to determine if changes occur in the market place that would enable greater competition.
8. Market Research: Market research was performed by the technical experts from the SEC CALM team during the month of October 2015. Searches were performed on the Army Computer Hardware Enterprise Software Solutions (CHESS) and National Aeronautics and Space Administration (NASA) Solutions for Enterprise Wide Procurement (SEWP), and General Services Administration (GSA) websites. Army CHESS website revealed Department of Defense (DoD) Oracle Enterprise Service Initiative (ESI) agreements with: DLT Solutions, W91QUZ-06-A-0002; Mythic, Inc., W91QUZ-06-A-0003, Immix Technology, Inc., WP1QUZ-08-A-0001, and Affigent, W91QUZ-09-A-0001. However, a query sent to Oracle revealed that Oracle JAVA SE support is proprietary to Oracle and that Oracle has not authorized any other companies to provide support for JAVA SE. A CHESS Statement of Non-Availability (SoNA) Number 216702143 was received for this requirement.
9. Interested Sources: The Government Point of Entry (GPE) notice required by FAR 5.201 will be published on the Federal Business Opportunities Page. Any proposals that are received shall be considered.

b. Acquisition Data Availability: The Government possesses only a commercial purchase description for the software. Technical data for the JAVA SE licenses and support service are proprietary to Oracle America. The commercial purchase description does not provide enough technical information to allow other vendors to create the functionality of this product.
c. Subcontracting Competition: Although there are no FAR subcontracting provisions that require competition among potential subcontractors for commercial contracts, the Government will seek to maximize subcontracting competition with a focus on subcontracting to small and small disadvantaged businesses.

APPROVAL
Based on the foregoing justification, I hereby approve the award of a Firm-Fixed-Priced contract for the sole source acquisition of Oracle Java SE Support, quantity 960 unit in support GCCS-A. The proposed contract will be awarded on other than full and open competition basis pursuant to the authority of 10 U.S.C.2304(c) and FAR 6.302-1 subject to the availability of funds, and provided that the services and property herein described have otherwise been authorized for acquisition. FY2016 Operation and Maintenance Army (OMA) funds will be used for this effort. If the proposed contract action is not completed within 180 days from the below date, this Justification and Approval shall be reviewed again by the contract specialist and contracting officer for revalidation. Additionally, if any changes to the requirements, basis for the justification, market conditions or increases in the estimated value of the proposed action occur at any time, the Contracting Specialist shall document these changes in a memorandum and obtain review/concurrence from a supervisory contracting officer.
