About this file

This document is a justification for a sole source award of a contract for advanced combat and marksmanship training simulator services. The U.S. Army Contracting Command plans to award a sole source bridge contract to Conflict Kinetics Corporation for simulator services to support soldier training at the 173rd Infantry Brigade Combat Team. The services include virtual-based shooting qualifications, system sustainment, and subject matter expertise. The period of performance is from December 2020 until a new contract awarded through full and open competition can begin in mid-2021. Under the previous contract awarded through full competition, Conflict Kinetics Corporation was the only vendor that met all requirements. The justification cites the need to ensure training continuity and avoid gaps in services while the follow-on competition is conducted.

Text version

Version – March 2017 FOR OFFICIAL USE ONLY normal conditions can take 4-8 weeks; however, due to COVID-19, requirements are taking substantially longer, the individual(s) will be then required to quarantine for 14 days upon arrival (and at times, quarantine prior to arrival or obtain a negative result within days of travel). This is inherent to all contractors currently not operating in USAREUR. The current vendor (Conflict Kinetics Corp.) has personnel on site that have passed all US, European, and Italian COVID-19 requirements for working in Italy and have passed and completed all USAREUR G1 requirements. These Conflict Kinetics personnel are able to remain, ensuring training availability and continuity. The delay in training, based on contractor personnel availability poses an unacceptable risk to readiness.

Alternatives:

As discussed above, the 2 current USAREUR systems, EST’s and SAM-T are unable to meet TC 3.20.40. (Individual Weapons Training Strategy) and TC 3.20.0 (Collective Weapons Qualification standards). Furthermore conducting TC 3.20.40 familiarization, certification and qualification during live fire increases cost significantly, and reduces throughput, which is not in accordance with Table II and IV requirements of TC 3.20.40.

Due to time available, it would not be cost effective nor realistic to expect another contractor to perform during this brief interim period. An action of this size would require 120-180 days to procure, resulting in a gap of service which at this time creates a significant impact to 173rd’s readiness. Additionally, factoring in work visas and the COVID-19 quarantine time, a new contractor would not be able to realistically begin service until the mid-calendar year 2021.

6. Efforts to Obtain Competition: In accordance with FAR 13.501, this action will not be synopsized. However, the follow-on procurement will employ full and open competition.

7. Actions to Increase Competition:

Although this interim contract action will not be competed, this action will provide the Government the necessary time to develop the follow-on contract to further meet 173rdIBCT(A) needs for the virtual-based shooting qualifications. This follow-on solicitation will be solicited using full and open competition.

8. Market Research: Market research was conducted by the RCO through a sources-sought notice posted on beta SAM.gov on 7 August 2020. The sources sought used scope characteristics loosely based on the training requirements outlined in TC 3.20.40 and TC 3.20.0. This sources sought notice attracted 5 vendors with the apparent capability of providing simulated Combat Marksmanship and Advanced Marksmanship training and simulation/simulator services. Since the sources sought determined that there are vendors in the industry capable of performing the service, the recommendation was made to pursue full and open competition. However, as detailed above, this action would require 180 days to procure. Therefore, it is in the Government’s best interest that the current contractor Conflict Kinetics Corp. fulfil this interim solution while the follow-on using full and open competition is developed.

As discussed above, this demonstrates that qualified vendors exist, however the ability to meet a performance start date of 1 December 2020, is not feasible at this time.
