JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

1. CONTRACTING AGENCY: US Army Corps of Engineers (USACE), Walla Walla District

(CENWW-CT) 201 North 3rd, Walla Walla, WA 99362.

2. DESCRIPTION OF ACTION: The purpose of this contract is for water extraction, drying, and dehumidification from the USACE Walla Walla District Headquarters building in response to interior flooding caused by a ruptured fire protection water line. Estimated amount of purchase is on file.

3. DESCRIPTION OF SUPPLIES/SERVICE: The work shall be performed at the U.S. Army Corps of Engineers Walla Walla District Office, 201 North 3rd Avenue, Walla Walla, WA 99362.

Specific Tasks to be performed:

a. Perform inspection to determine extent and limits of water exposure throughout the interior of the building and develop a flood map of the affected areas. Report of inspection shall include a record of moisture readings for the areas that experienced water exposure.

b. Perform extraction and removal of standing water.

c. Perform drying and dehumidification to remove water retained by building materials.

d. Perform required demolition and removal of saturated areas such as ceilings, walls, soffits, and insulation to facilitate drying and dehumidification.

e. Identify and test electrical and communication circuits exposed to water to determine serviceability.

f. Perform water extraction, drying, and dehumidification in the elevator shaft and sump areas.

g. Perform required demolition and removal of saturated materials such as walls, insulation, baseboards, wall paper, and floor tile in the Atrium vending machine area to facilitate drying and dehumidification.

4. AUTHORITY CITED: FAR 6.302-2 Unusual and Compelling Urgency (1) Citations: 10 U.S.C.

2304(c)(2) or 41 U.S.C. 3304(a)(2) (a)(2) When the agency’s need for the supplies or services is of such an unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals, full and open competition need not be provided for.

5. REASON FOR AUTHORITY CITED:

a. BACKGROUND: On 17 January 2017 at 11:30 pm the fire department was alerted by a fire alarm at the Walla Walla District Headquarters Building. The building POC was called in and found that a fire sprinkler pipe had burst at the east entrance and was flooding multiple areas of the building. At that time 5 Star Disaster Services was the only vendor that was able to respond in the time frame required. 5 Star extracted most of the water but was unable to address standing water beneath the raised access floor nor did they have the capability to completely dry the building. They left their equipment in place to maintain conditions while the Corps performed market research to identify companies that had the required capabilities.

Two companies were identified as being capable; ServPro and Belfor. Belfor was not available to perform the work. Two separate ServPro companies accepted an invitation to a site visit the next day. When ServPro of Pasco learned that the Corps had also contacted ServPro of NW Spokane they admitted that after seeing the damage they would have to subcontract with ServPro of Spokane as they had the special equipment necessary to completely dry the building structure. They recommended that the Corps hire ServPro of NW Spokane directly.

b. JUSTIFICATION: 48 hours had passed since the pipe had burst. Bringing in a moisture monitor was crucial to identifying the extent of the water damage in the building materials.

The more time that passes the more the water “footprint” dissipates making it more difficult to identify the extent of the damage. ServPro of Spokane was available and had the required equipment to perform the work. Conducting additional market research would delay the critical moisture monitoring with a potential outcome of mold growth in undetected areas.

c. IMPACT: Delay in taking moisture readings and continuing the moisture removal with appropriate equipment would result in the potential growth of harmful mold and structural damage to the building and infrastructure. This in turn could threaten the health and safety of Corps employees.

d. ALTERNATIVES: Delay the moisture readings, and continue using 5 Star’s fans until more capable companies with the equipment required could be contacted for competition. However this alternative, with a time delay, could result in the growth of black mold and further structural damage endangering the occupants of the building.

6. EFFORTS TO OBTAIN COMPETITION: Three vendors were contacted. One was not available.

One would have to sub-contract out the work increasing the cost of the work through a mark-up on costs.

7. DETERMINATION OF A FAIR AND REASONABLE PRICE: This industry (fire and water restoration) uses standard insurance rates for all equipment and labor hours. In addition, an IGE was developed for comparison and ServPro’s proposal was significantly lower.

8. MARKET RESEARCH: Three vendors were identified. Belfor was not available for three weeks.

ServPro of Pasco could not do the work without ServePro of NW Spokane as a sub-contractor.

ServPro of NW Spokane had the equipment and a crew returning from Boise that could be diverted to Walla Walla on the same day as the walk through on 20 January 2017.
