SOLE SOURCE JUSTIFICATION

(Simplified Acquisition Procedures under FAR Part 13 Not Exceeding $750K)

1. Agency/Contracting Activity U.S. Army Corps of Engineers, Charleston District, Charleston Contracting Office, 69-A Hagood Avenue, Charleston, SC 29403-5107

2. Description of Action:

Nature: New Requirement Follow-on Requirement Mod to Existing Purchase Order/Contract Number

Pricing: X Firm-Fixed Price Time & Materials Funds: OMA Other Funds:

Name of Proposed Contractor(s): PUREHM U.S. Inc SAI Systems International INC.

Street Address: 56 Bradley Street 5 Research DR 2 City, State, Zip: Middletown, CT 06457 Shelton, Connecticut Phone: 860.635.1500 203

3. Description of Services or Supplies:

This is a follow-on procurement action to acquire a highly specialized sole source supply. The requirement is an Annual Access/Maintenance Subscription renewal for twelve (12) HYPACK (HYSWEEP) keys. This will be a firm-fixed price purchase order for an estimated total value of and will include four (4) option years of Annual Access/Maintenance Subscription of the HYSWEEP Office Keys and HYSWEEP Survey Keys.

4. Authority Cited: Action using simplified acquisition procedures:

FAR 13.106-1 (b)(1): For purchases not exceeding the simplified acquisition threshold (SAT), contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g. urgency, exclusive licensing agreements, brand name, or industrial mobilization).

5. Reasons for Authority Cited:

PUREHM U.S. Inc is the only business who can provide the HYPACK (HYSWEEP) keys and USBs. The HYPACK (HYSWEEP) keys are also currently mandated by the United States Army Corps of Engineers (USACE) as an Industry standard to support USACE’s overall mission.

Hypack Software will help the Hydrographic Survey Community of Practice accomplish the USACE Navigation mission to provide safe, reliable, efficient, and environmentally sustainable waterborne transport navigation channels for the movement of commercial goods, for national security needs, and for recreation. In addition, the HYPACK Maintenance Plan services (which includes Technical support and Program updates) are provided exclusively through HYPACK.

HYPACK training will also be provided by their HYPACK Certified Technical team.

HYPACK software is comprehensive in its ability to enable data collection, post-processing, and product creation from the variety of hardware sensors employed by USACE districts. Additionally, it is equally compatible with computers aboard Data Collection Platforms (survey boats) and CorpsNet computers. HYPACK software has been an accepted software on the ACE-IT App Portal and is certified with CorpsNet platform and Army G-6. HYPACK works with all COTS sensors and positioning devices used in USACE Hydrographic Survey. HYPACK developers have made dozens of improvements to their software based directly on input offered by USACE teams.

USACE has made an enormous capital investment in HYPACK software, there are approximately 500 hardware keys and licenses, with a cost up to $12,125 each. Training requirements for a wholesale change to another software system would cause mission stoppage for up to a year or more. Paying software maintenance is a mere fraction of replacing existing keys at full price or adopting another vendor’s solution wholesale. The process of adopting HYPACK, enterprise-wide, for most of our Hydrographic Survey workflows has evolved over 25+ years. Since the adoption of USACE eHydro as an enterprise Hydrographic Survey repository, HYPACK has developed many tools that enable more efficient workflows from HYPACK straight into our eHydro processes.

USACE districts upload hundreds of hydro surveys, every month, with the benefit of specialized HYPACK tools every district can view data sets especially if there was a major weather event such as a Hurricane. USACE currently had global tech support, with 24/7 availability, which is important for our districts such as Pacific Ocean Alaska (POA), Pacific Ocean Hawaii (POH) Districts in distant time zones.

6. Efforts to obtain competition: The government is limited to only one source who can provide the software upgrades. PUREHM U.S. Inc. is the only source to provide the requested, there are no other resellers.

7. Actions to increase competition: This J&A supports a discrete requirement that will end when the project is complete. Therefore, there are no planned actions to increase competition for the requirement covered by this J&A.

8. Market Research: Market research was conducted by contacting PUREHM U.S. Inc for a list of current resellers. PUREHM U.S. Inc. is the sole developer and provider of the HYPACK Hydrographic Survey software, the only provider of this type of supply and the only source that can provide the software upgrades.

9. Other Interested Sources: None

10. Other Facts: In order for the Government to remove or overcome any barriers to competition, it would require this technology to be widely available in the marketplace and at this time it is not.
