JUSTIFICATION & APPROVAL
FOR OTHER THAN FULL & OPEN COMPETITION
1. CONTRACTING AGENCY: U.S. Army Engineer District, Alaska, Contracting Division, P.O. Box
6898, JBER, Alaska 99506-6898.
2. DESCRIPTION OF ACTION: This is a justification and approval (J&A) for other than full and open competition to increase the capacity of an existing indefinite delivery architect-engineer (AE) contract for Geotechnical Design and Related Services Primarily Various Locations. The contract has a current value of $ for five years. This request is to increase the capacity by $ to $ .
3. BACKGROUND: On 3 April 2020, the Alaska District advertised for a Geotechnical Indefinite
Delivery contract. W911KB21D0001 was awarded to Golder Associates Inc. on 26 July 2021. The current contract capacity has been utilized much quicker than originally anticipated due to an increased workload. As a result, a new Geotechnical Indefinite Delivery contract was advertised on 27 June 2023 by the Alaska District with the intent to award three contracts with a shared capacity of $25M. Award of the new Geotechnical IDIQ is not anticipated until the 2nd quarter of FY24, therefore additional capacity is required on W911KB21D0001 to support multiple projects and anticipated modifications, specifically to support the award of a new task order for a Geotechnical Data Report for Elim Subsistence Harbor in Elim, Alaska. The offshore geotechnical data is to be collected by drilling off the ice sheet, as a barge to perform summer drilling could not be located. Ice conditions where drilling can be safely performed have a limited time window (typically Feb. – March) before ice conditions can rapidly deteriorate and prematurely end field programs. The field logistics, mobilization, and offshore drilling off the ice cannot occur before the Alaska District awards the new contract. Increasing capacity of this contracting tool will allow the Alaska District to pursue award of this task order.
4. DESCRIPTION OF SERVICES: The proposed contract action will provide the typical types of services for Geotechnical Design and related engineering services, including but is not limited to:
geotechnical design analyses and recommendations; subsurface/field investigations; geotechnical reports and studies covering vertical and horizontal facilities, pavements, structures, slopes and earthwork; forensic inspections of existing facilities; field and laboratory testing of soil, rock, groundwater, and various construction materials; groundwater studies; material source evaluations;
and environmental site investigations involving hazardous, toxic, or radiological waste (HTRW).
The A-E may also be required to provide geotechnical analyses and recommendations for:
planning, design and construction of foundations, pavements, earth structures, embankments, dams, levees, harbors, underground structures, and slopes; analysis of static and seismic stability;
site-specific seismic hazard assessments and related impacts on planned or existing facilities;
geologic and geophysical site characterization; ground improvement; instrumentation and monitoring of geotechnical-related features in design and construction; and selection of appropriate abatement methods concerning HTRW materials present on project sites. Design and engineering deliverables may include narrative geotechnical recommendations, plans, specifications, basis of design, cost estimates, design reviews, field and laboratory test results, analysis of test results, graphics, reports and studies, and presentations of findings, conclusions, and recommendations at project meetings.
5. AUTHORITY CITED: Other than Full and Open Competition is authorized pursuant to:
10 U.S.C. 2304(c)(2), FAR 6.302-2, when the agency’s need for the supplies or services is of such an unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals, full and open competition need not be provided for.
6. REASON FOR AUTHORITY CITED: The referenced contract to Golder Associates Inc. capacity of $ is not adequate to support the current workload before the award of the new Geotechnical IDIQ.
A. The Alaska District relies heavily upon our AE Geotechnical consultants as there is not the capacity or certified skills sets within the District at this time to perform the design recommendations and analysis as needed.
B. It is necessary to have the capability to initiate projects on to Golder Associates Inc.’s contract to ensure success of meeting the customer’s needs for the work. It is not possible to wait for the new indefinite delivery contract to be awarded and still successfully meet the required schedule of the customer.
7. EFFORTS TO OBTAIN COMPETITION: The Alaska District is in the process of establishing replacement Geotechnical IDIQ contracts which will be procured in accordance with the Brooks Act as outlined in paragraphs 8 and 9 below.
8. ACTIONS TO INCREASE COMPETITION: The Alaska District advertised on SAM.gov website for one new Geotechnical Indefinite Delivery Multiple Award Task Order Contract (MATOC). The award is anticipated for the 2nd quarter 2024.
9. MARKET SURVEY: Market research for the new Geotechnical IDIQ was accomplished via sources sought notice responses on 8 December 2022. Based on the interested firms that responded to the sources sought notice, the new Geotechnical IDIQ contracts were solicited as a full and open acquisition.

12. FAIR AND REASONABLE COST DETERMINATION: Total cumulative contract action amount will not exceed $ . The contracting officer will rely on an independent government estimate and historical data as a basis of reasonableness for specific task orders under this contract.
The Alaska District does not anticipate any changes to the existing fee schedules for labor rates and overhead rates established on the current contract.
