JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

(SOLE SOURCE/BRAND NAME ITEM UNDER THE SIMPLIFIED ACQUISITION

THRESHOLD)

1. CONTRACTING AGENCY: US Army Corps of Engineers (USACE), Little Rock District (CESWL- CT) 700 W. Capitol Avenue, Little Rock, AR 72203.

2. DESCRIPTION OF ACTION: The proposed action is for the purchase of AZ31 magnesium rod anodes. Anodes procured through this action would be used to replace deficient anodes on hydraulic steel structures to provide the structure with sufficient protection against corrosion.

3. DESCRIPTION OF ITEMS: 200 Extruded AZ31 Magnesium rods, 2.024” Diameter by 240” (20 ft) in length with one end plain, the other end threaded.

4. AUTHORITY CITED: FAR 13.106-1(b)(1)(i)

5. REASON FOR AUTHORITY CITED: Magnesium is the standard material used to produce sacrificial anodes for freshwater applications. Alternative products, such as zinc anodes, would not provide sufficient protection against corrosion for the navigation structure. MAG Specialties manufactures magnesium rod anodes which will provide an oxidation potential of 1.4 volts in freshwater environments.

Their product will provide sufficient cathodic protection to the navigation structure to meet this action’s requirements. The product brand name is GALVORODTM.

6. EFFORTS TO OBTAIN AND INCREASE COMPETITION: MAG Industries advertises detailed product information for their GALVORODTM products. This information will be provided along with the contract advertisement, allowing competitors to bid on the contract with equivalent products.

7. FAIR AND REASONABLE COST DETERMINATION: A determination of price fairness and reasonableness will be made based on competition, and if required, an Independent Government Estimate and internet catalog pricing.

8. MARKET RESEARCH: Market research indicates that Magnesium based rod anodes meeting the requirements and specifications needed for this action can be provided by multiple companies, including MESA, Galvotec, Farwest Corrosion, and MAG Specialties.

9. APPROVAL: Based on the foregoing, it is determined to be in the best interest of the Government to include MAG Specialties’ GALVORODTM product information with the contract advertisement to allow open competition for this action.
