DETERMINATION FOR OTHER THAN FULL AND OPEN COMPETITION

(SIMPLIFIED ACQUISITION PROCEDURES BRAND NAME)

1. Contracting Activity:

U.S. Army Corps of Engineers, Huntington District, CELRH-CTD, 502 8th Street, Huntington, WV, 25701

2. Description of Action:

In accordance with Federal Acquisition Regulation, Part 13.106-1(b)(i), the action submitted for approval is for a brand name procurement of multi-parameter datasondes.

The action submitted is to purchase equipment compatible with current equipment used The cost of this requirement exceeds the Government Visa purchase thresholds. FY20 funds will be used for this supply contract. The total estimated cost for this supply is approximately xxxxxx.

3. Description of Supplies/Services:

Multi-parameter datasondes, sensors, and accessories (see attached comprehensive list).

4. Authority Cited:

The statutory authority permitting other than full and open competition for this acquisition is 10 U.S.C. § 2304(c)( -name commercial item.

5. Reason for Authority Cited:

Water Management Section, Water Quality Team incorporates physical and chemical parameters in assessment of water quality at Huntington District projects. This data is necessary to appropriately monitor and manage the water quality upstream, downstream, and within our lakes. Data collected from these assessments will be integrated with biological and other chemical data to form a more complete understanding of water quality at each project. The system is to be utilized for physical and chemical assessments at five to seven projects per year in accordance with the Water Quality Annual Operating Plan. The Water Quality Team currently uses YSI brand multi-parameter datasondes, sensors and accessories to include, EXO1, EXO2, and EXO3 datasonde platforms which requires brand specific dissolved oxygen, conductance, pH, temperature, turbidity, phycocyanin, ORP, and chlorophyll sensors, cables, and handheld readouts. In order to ensure compatibility with current equipment, YSI equipment must be purchased due to proprietary connections and accessories.

Acquiring a different brand would require a complete re-purchase of necessary

sampling equipment to make operational packages and the old equipment would not be operational due to incompatible accessories.

6. Efforts to Obtain Competition:

In accordance with FAR 5.101 and 5.102, competition will be obtained by posting a Solicitation to Federal Business Opportunities (FBO) to allow all interested vendors to submit quotes for the required products. Vendors will be provided no less than three (3) business days to submit quotes.

7. Actions to Increase Competition:

Not applicable see paragraphs 4 and 5 above.

8 Market Research:

YSI equipment is only available from Xylem Analytics distributers.
