Justification for other than full and open competition 41 U.S.C 3304(a)(3) and FAR 6.300

(1) Identification of the agency and the contracting activity: Commodity Futures

Trading Commission, Financial Management Branch.

(2) Nature and/or description of the action being approved. Booking of conference space & AV Support.

(3) A description of services required to meet the agency’s needs (including the estimated value).

The Commodity Futures Trading Commission (CFTC) requires conference space and AV support in Overland Park, KS on April 11th and 12th, 2019.

The Division seeks to award this requirement to Marriott International Inc.

The estimated value of all tasks is $50,000.00.

(4) An identification of the statutory authority permitting other than full and open competition. 41 U.S.C 3304(a)(3) - Use of noncompetitive procedures. FAR 6.302-1

(5) A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited.

This conference is being coordinated with Kansas State University, and Kansas State University has selected the Marriott in Overland Park, KS as the location of the conference. Because this conference is being jointly planned, only the Marriott International in Overland Park, KS can provide the required conference space and AV support.

(6) A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. Other vendors were not solicited for this effort.

This action was publicized in accordance with FAR 5.102.

(7) A determination by the Contracting Officer that the anticipated cost to the

Government will be fair and reasonable. The Contracting Officer has determined the cost to the Government of is fair and reasonable.

(8) A description of the market research conducted and the results or a statement of the reason market research was not conducted. There are other hotels available in the area with comparable rates. However, only the Marriott in Overland Park, KS is capable of providing the space required by the conference partner, Kansas State University.

(9) Any other facts supporting the use of other than full and open competition.

None.

(10) A listing of the sources, if any, that expressed, in writing, an interest in the acquisition.

None.

(11) A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. When possible, CFTC will make every effort to compete future conference center purchase orders.

(12) Certification and approvals:

Contracting Officer Certification I certify that the above justification is accurate and complete to the best of my knowledge and belief.
