FEDERAL MEDIATION AND CONCILIATION SERVICE
One Independence Square

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
BRAND NAME ONLY
1. Contracting Agency. Federal Mediation and Conciliation Service (FMCS), Washington, DC.
2. Nature of Action Being Approved. FMCS proposes to award a new firm-fixed price purchase order for two (2) NetApp HCI solutions.
3. Description of Supplies or Services. FMCS has a requirement for two (2) NetApp HCI solutions, each with a 60-month warranty. One solution will be located at FMCS Headquarters, 250 E Street SW, Washington, DC 20427 and one will be located at 1120 Old Elkins Road, Buckhannon, WV 26201.
Delivery of both systems is 60 days after award.
4. Estimated Dollar Total Value. $330,000.00
5. Statutory Authority. The statutory authority for this action is 11.105(a)(1). The particular brand name, product, or feature is essential to the Government’s requirements, and market research indicates other companies’ similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency’s needs.
6. Applicability of Authority: FMCS currently owns NetApp storage hardware (FAS8020A units and headers) which will be used in conjunction with the HCI solutions being procured. Procurement of a non- NetApp HCI solution may cause incompatibility issues and would increase downtime due to FMCS personnel having to learn a new system and figure out how to integrate it into the existing environment.
7. Efforts To Obtain Competition: The Contracting Officer will post this requirement on FedBizOpps for a period of not less than seven (7) days.
8. Fair and Reasonable: It is anticipated that multiple quotes will be received in response to the solicitation posted on FedBizOpps. Consequently, fair and reasonableness will be based on adequate price competition.
9. Market Survey: Market research foud that multiple small businesses can provide the exact items needed by FMCS.
10. Further Competition: Prior to the warranty for the new solutions expiring, market research will be conducted to find out if other brands are compatible with FMCS’ existing system, thus allowing for more competition.
11. Contracting Officers Certification: I hereby certify that, to the best of my knowledge, this justification is accurate and complete.
