ATTACHMENT 1

Statement of Work

I. Background Information

The United States Department of Agriculture (USDA), Agricultural Research Service (ARS), National Agricultural Library (NAL) requires electronic access for all USDA users and public on-site users to scientific journals published by the American Phytopathological Society.

II. Requirements

1. The contractor shall provide IP-authenticated electronic access via the Internet to American Phytopathological Society journals for use by all USDA employees, contractors, authorized public on-site users, cooperators and volunteers working on behalf of USDA and acting within the scope of their relationship with USDA. All USDA locations worldwide are to be considered authorized premises. In addition to internal use, authorized users have the right to use content of the journals for ordinary business, scholarly and educational purposes of the Government, including but not limiting to viewing, printing, saving, reusing and disseminating content.

2. The contractor shall make the American Phytopathological Society journals accessible 24 hours per day. Authorized users shall be granted access through the IP recognition authentication process without any impediments.

3. The contractor shall provide the American Phytopathological Society journals in accordance with the following terms and conditions:

a. The authorized users shall have the right to use content during the term of the subscription.

b. The authorized users shall have post-cancellation access to previously subscribed content via the contractor’s website or other mutually-agreeable IP authenticated mechanism.

c. The contractor shall grant perpetual data rights to the subscribed-to content.

d. Upon request by NAL the contractor shall provide the subscribed-to or purchased content in a mutually agreed-upon electronic medium and format. e.

The right to perpetual use of the subscribed-to content will survive the termination of the contract for any reason.

4. The contractor shall provide access to the subscribed content and the administrative interface without imposing on the subscriber’s users any additional terms and conditions or similar restrictions that are not part of the contract. If the contractor’s system’s technical functionality prevents suppression of such terms and conditions or similar restrictions, the contractor agrees that any language, however construed and presented, is null and void and not binding on the subscriber’s users.

III. Schedule of Deliverables

Deliverable Due Date

1. Provide access via the internet to selected American Phytopathological Society journals

Within 3 days of award

2. Provide COUNTER-compliant usage statistics for all users including commonly recognized data elements.

Monthly

3. Usage statistics shall include the (IP) address of every user and their respective use of American Phytopathological Society journals, if available.

Annually

4. Provide and maintain administrative credentials for access to institutional administrative interface for the purposes of customization, usage data retrieval and other administrative purposes, as permitted by the system
