4. FAR 6.303-2(b)(4) – An identification of the statutory authority permitting other than full and open competition:

The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1. Only one responsible source and no other supplies or services will satisfy agency requirements.

5. FAR 6.303-2(b)(5) – A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited:

As part of the Mobile Launcher 2 (ML2) Design and Fabrication contract, Bechtel is performing a significant portion of the ML2 Fluids Systems Analysis in Bentley AutoPipe.

Consolidated Operations, Management, Engineering and Test Contract (COMET) Fluids Design Engineering/Pressure Vessel System (DE/PVS) and Analysis groups will also require access to this software in order to review these analysis models and will be required to produce supplementary analysis in support of PVS and Design Certification Review (DCR) activities. Failure to acquire the AutoPipe subscription would result in severe degradation to NASA’s mission due to COMET being unable to read or analyze Mobile Launcher 2’s model analysis by Bechtel as well as perform the supplementary analysis in support of PVS and DCR, which is necessary for launch. AutoPipe is exclusively licensed through Bentley.

NASA KSC uses Bentley’s products in an enterprise license agreement to save money across other contracts at KSC, including the Base Operations and Spaceport Services (BOSS) contract. The suite of Bentley software products is utilized for a wide variety of tasks ranging from engineering, Computer-Aided Design (CAD) software (including architectural software), space utilization, document management, and viewers. Bentley ProjectWise is a key software component of that suite of Bentley products and the NASA BOSS contract uses it to support NASA KSC on a daily basis.

Bentley ProjectWise is also a necessary component of NASA KSC’s Space Utilization system; NASA uses Bentley Connect, Bentley Architectural Open Building, Bentley ProjectWise, and Bentley Viewer software to work with IBM’s TRIRIGA space management software to create, store, and manage all the live floor plan files and versions, as well as providing floor plan viewer capability to the Center’s personnel.

Bentley products are made to work efficiently together and a change to any one of these software packages can negatively impact the entire process. A change in software can realistically lead to having to redraw and relink approximately 900 facility floor plans, which would be a costly endeavor requiring thousands of hours of labor.

The learning and implementation of a different product would take significant time and effort and would severely impact the productivity of current users if another product was used.

Implementing an alternative solution would take over 12 months of research, analysis, design and testing. This specific suite of products is included as Government Furnished on several contracts, which require this suite of products to complete their requirements.

6. FAR 6.303-2(b)(6) – A description of the efforts made to ensure that offers are solicited from as many potential sources as practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies:

A notification was posted on the Government Point of Entry (GPE) website, sam.gov, in compliance with FAR Subpart 5.2. This announcement served to inform interested parties about NASA’s plan to award a sole-source purchase order to Carahsoft. A summary of the synopsis outcomes can be found in section 10.

7. FAR 6.303-2(b)(7) – A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable:

The Contracting Officer’s signature on this document indicates that the Contracting Officer has determined that the anticipated cost to the government will be fair and reasonable. The Contractor shall be required to submit a proposal to be evaluated and negotiated by the Government. Prior to execution of the contractual instrument, a proposal analysis will be performed. The proposal analysis will ensure that the final agreed-to price for the contract action is fair and reasonable.

Historical prices found reasonable on previous purchases are available and will be used for comparison in the proposal analysis to determine if proposed prices are reasonable. Additionally, the contracting activity shall also request a current commercial price list to further ascertain the reasonableness of the pricing offered. The contracting activity is unaware of any issues that would circumvent a fair and reasonable price determination.

8. FAR 6.303-2(b)(8) – Description of the market research conducted, and the results, or a statement of the reasons a market research was not conducted:

The contracting activity queried the NASA Strategic Sourcing Repository, the NASA Solutions for Enterprise-Wide Procurement (SEWP) and the General Services Administration (GSA) eLibrary to examine the market for any change removing barriers to competition, allowing new sources an opportunity to meet the requirement for fiscal year 2024.

Using the product code and description for each item, the contracting activity initiated a targeted search for value-added resellers authorized to renew maintenance service for existing software licenses.

Upon conducting market research, it has been affirmed that the required services for this procurement can indeed be made through the SEWP vehicle. However, considering the time constraints and mission critical nature associated with the completion of this procurement, a strategic decision has been made to pursue an open market approach. While SEWP remains a
