GEORGE C. MARSHALL SPACE FLIGHT CENTER

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION (JOFOC)

PURSUANT TO TITLE 10 U.S.C. 2304(c)(1)

1. This document is a Justification for Other Than Full and Open Competition (JOFOC) prepared by the NASA Marshall Space Flight Center (MSFC) in accordance with Federal Acquisition Regulation (FAR) Part 6.3, Other Than Full and Open Competition, and NASA FAR Supplement (NFS) Part 1806.3, Other Than Full and Open Competition.

2. Nature and/or description of the action being approved: This procurement is for the

Concurrent Real-Time hardware maintenance of the ImaGen and iHawk rack mount systems plus peripheral devices and NightStar software in support of the avionics system testing and development within the Integrated Avionics Test Facilities (IATF) which includes the System Integration Labs (SIL), the Software Development Facilities (SDF), and the System Integration Test Facilities (SITF). These labs perform the integration and testing of the avionics systems and flight software for the new launch vehicles.

3. Description of the supplies or services required to meet the agency’s need, including estimated value: Renewal of the NightStar software maintenance and hardware maintenance for the iHawk and ImaGen rack mount systems plus peripheral devices supporting the MSFC IATF labs under the Vehicle Integration project within the Space Launch Systems program (SLS). The total estimated cost of this effort is $272,819.41 and the estimated period of performance is fourteen (14) months.

4. Statutory authority permitting other than full and open competition: This recommendation is made pursuant to FAR 6.302-1, which implements the authority for 10 U.S.C. 2304(c)

(1) for acquisition of supplies or services from only one source and no other supplies or services will satisfy agency requirements.

5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires the authority cited: Concurrent Real-Time provides the ImaGen and iHawk systems with their proprietary RedHawk Linux real-time operating system as well as the certification for these systems. Because of the complexity of the real-time computing, the systems running the real-time operating system must be certified by the provider of the systems. All peripheral input/output (I/O) devices and their associated driver software must be certified by the real-time operation system vendor. Concurrent Real-Time’s proprietary RedHawk Linux real-time operating system is the real-time operating system currently used throughout the IATF labs. They guarantee the real-time performance of these systems and the peripheral I/O hardware meets the IATF’s specific requirements. Concurrent Real-Time maintains the systems and peripheral I/O devices to these standards. They are the only vendor that can provide the maintenance for the iHawk and ImaGen systems, NightStar software, and the peripheral I/O devices. The compatibility and functionality of the Concurrent Real-Time servers and systems with the other hardware and equipment used in the IATF labs is well-established and must be maintained.

6. Description of the efforts made to ensure that offers are solicited from as many potential sources as practicable: Pursuant to FAR 5.201; this proposed contract action will be synopsized in the Federal Business Opportunities (FBO). Any questions or comments received from industry will be dispositioned appropriately and documented within an addendum to this document.

7. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable: Determination will be based upon established catalog price list and past procurements.

8. Description of the market survey conducted, and the results, or a statement of the reasons a market survey was not conducted: Market research and product evaluations were conducted by the simulation development engineers of ES53. Candidate systems were obtained and tested for evaluation. ES53 also relied on the expertise of contractors who have designed and implemented real-time hardware-in-the-loop simulation facilities at other Government agencies: military and aerospace contractors. The two year research and evaluation found that the equipment required by this acquisition is not available from any other manufacturer. The real-time operation system evaluation resulted in Concurrent Real-Time’s RedHawk operating system being the only real-time operating system capable of meeting all the Government requirements.

9. Other facts supporting the use of other than full and open competition, such as technical data packages, specifications, engineering descriptions, statements of work, or purchase descriptions suitable for full and open competition are not viable due to the proprietary nature of RedHawk Linux real-time operating system. The Concurrent Real-Time brand servers are used in all of the IATF labs, test and development lines. The guaranteed performance, functionality and compatibility between the servers and other hardware must be maintained. Choosing another vendor for the maintenance adversely affects the reliability and functionality of the Concurrent Real-Time systems. This would create a time consuming activity with immeasurable impacts to cost, manpower hours, and schedules not able to be estimated in this summary.

10. Sources, if any, that expressed an interest in writing in the acquisition: Pursuant to FAR 5.201;

this proposed contract action will be synopsized in the Federal Business Opportunities (FBO).

Any questions or comments received from industry will be dispositioned appropriately and documented within an addendum to this document.

11. The actions, if any, the Agency may take to remove or overcome barriers to competition before any subsequent acquisition for the supplies or services required: There are no known actions which the agency may take to remove or overcome barriers to competition before any subsequent acquisition for the systems required. For the above reasons, full and open competition is not feasible. Therefore, purchase of the supplies or services from Concurrent Real-Time is the only practical approach.

12. I hereby certify the facts in this justification and any supporting data used for this justification are accurate and complete to the best of my knowledge.
