JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
(JOFOC)
For 80GRC023PA016
1. Federal Acquisition Regulation (FAR) 6.303-2(b)(1) – Identification of the agency and the contracting activity, and specific identification of the document as a “Justification for other than full and open competition.”
This document is a justification for other than full and open competition prepared by
National Aeronautics and Space Administration (NASA) Glenn Research Center (GRC).
The procuring agency is NASA and the contracting activity is GRC.
2. FAR 6.303-2(b)(2) – The nature and/or description of the action being approved:
This justification provides the rationale for contracting by other than full and open competition to award a sole-source contract 80GRC023PA016 with Magna-Power Electronics, Inc. for the purchase of four (4) Magna-Power MTD700-357/480+ISO+LXI Power supplies.
The purpose of this procurement is to acquire four (4) 250,000W DC power supplies. The power supplies are identical to NASA Electronic Aircraft Testbed (NEAT)’s existing units.
NEAT is a test facility at Armstrong Test Facility (ATF) that allows the testing of high-power equipment for eventual use in hybrid-electric aircraft systems. It is one of the only facilities in the world that is able to test high-power systems and components under simulated altitude conditions. NEAT is part of the Power and Propulsion (P&P) sub-project, which is part of the Advanced Air Transport Technology (AATT) project. The P&P sub-project is exploring multiple technologies that would enable electric, or hybrid-electric, aircraft, resulting in quieter, more fuel-efficient, and more environmentally-friendly flight.
NEAT is expanding its power capability in order to test high power components required for hybrid-electric flight. This procurement is for four (4) power supplies, which will double the existing capability. The total cost will be approximately $590,000.
3. FAR 6.303-2(b)(3) – A description of the supplies or services required, to meet the
Agency’s needs (including the estimated value):
NEAT is currently using Magna-Power power supplies to power the testbed, and we are expanding the electric power of the facility. These additional power supplies will enable the testbed to conduct testing on higher power components required for hybrid-electric flight. It is important to keep the same kind of power supplies so that they can be used with the existing power supplies purchased in 2019 and 2022. Use of another type of power supply could result in an inability to control the facility’s DC electrical system, leading to an unstable system that is unsafe for both personnel and hardware. The total cost will be approximately $590,000 with delivery expected within six (6) months of purchase.
Specifications Input specifications include:
- 60Hz, 3 phase, 480VAC +/- 10%
- >0.96 power factor at max power
- +/- 2500VAC isolation to ground
Output specifications include:
- Voltage ramping:
o Programming shall allow the voltage to be linearly ramped up to maximum voltage over 15 seconds or less as programmed or controlled by user.
- Voltage Ripple:
o Less than 300mV at rated voltage
- Line Regulation :
o Voltage mode: ± 0.004% of full scale o Current mode: ± 0.02% of full scale
- Load Regulation :
o Voltage mode: ± 0.01% of full scale o Current mode: ± 0.04% of full scale
- Load Transient Response :
o 2 ms to recover within ±1% of regulated output with a 50% to 100% or 100% to
50% step load change
- Stability:
o ± 0.10% for 8 hrs. after 30 min. warm-up
- Efficiency:
o 86% to 88%
- Maximum Slew Rate:
o 100 ms for an output voltage change from 0 to 63% o 100 ms for an output current change from 0 to 63%
- Bandwidth:
o 3 Hz with remote analog voltage programming o 2 Hz with remote analog current programming
- DC Output Isolation:
o ±4000 Vdc, maximum output voltage to ground
Control specifications include:
- Voltage Programming Accuracy :
o ± 0.075% of max rated voltage
- Over Voltage Trip Programming Accuracy:
o ± 0.075% of max rated voltage
- Current Programming Accuracy :
o ± 0.075% of max rated current
- Voltage Readback Accuracy:
o ± 0.2% of max rated voltage
- Current Readback Accuracy:
o ± 0.2% of max rated current
- Load Regulation :
o Voltage mode: ± 0.01% of full scale o Current mode: ± 0.04% of full scale
- Must be compatible with existing Magna MT700 units in order to be used in master/slave configuration.
4. FAR 6.303-2(b)(4) – An identification of the statutory authority permitting other than full and open competition:
The statutory authority permitting other than full and open competition is 10 U.S.C.
2304(c)(1), as implemented by FAR 6.302-1: Only one responsible source and no other supplies or services will satisfy agency requirements.
5. FAR 6.303-2(b)(5) – A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited:
The rationale supporting the use of 10 U.S.C. 2304(c)(1) is the property or services needed by the agency are available from only one responsible source or only from a limited number of responsible sources and no other type of property or services will satisfy the needs of the agency; as described below:
This procurement is for additional units of a previous procurement because NASA must increase the overall power level at NEAT. In order to meet the NASA’s Annual Performance Indicator (API) milestone, NASA must order these exact power supplies to be compatible with the units purchased in the years 2019 and 2022. Only the identical power supplies are compatible with the current power supplies in NEAT.
6. FAR 6.303-2(b)(6) – A description of the efforts made to ensure that offers are solicited from as many potential sources as practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies:
A notice to the Government Point of Entry (GPE) website (Sam.gov) was published on July 6, 2023, in accordance with FAR Subpart 5.2. This posting informed potential sources of NASA’s intent to award this sole-source contract to Magna-Power Electronics, Inc. The results of this synopsis are summarized in Section 10 below.
7. FAR 6.303-2(b)(7) – A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable:
The Contracting Officer’s signature on this document indicates that the Contracting Officer has determined that the anticipated cost to the government will be fair and reasonable. The Contractor shall be required to submit a proposal to be evaluated and negotiated by the Government. Prior to execution of the contractual instrument, a proposal analysis will be performed. The proposal analysis will ensure that the final agreed-to price for the contract action is fair and reasonable.
This contract will be a firm fixed price for a commercial item. A similar procurement occurred in 2019 and 2022 and the cost proposal will be compared to this previous procurement. The cost proposal will also be compared to similar items on the market.
8. FAR 6.303-2(b)(8) – Description of the market research conducted, and the results, or a statement of the reasons a market research was not conducted:
In accordance with FAR 5.2, a description of this requirement was posted to the GPE website (Sam.gov) on July 6, 2023 and closed on July 21, 2023. The results are as follows:
one response was submitted. The response was determined to be not capable of fulfilling the government’s requirement. Thus Manga-Power Electronics, Inc. is the only contractor who can meet all of the government’s requirements.
9. FAR 6.303-2(b)(9) – Any other facts supporting the use of other than full and open competition:
None.
10. FAR 6.303-2(b)(10) – A listing of the sources, if any, that expressed an interest in writing in the acquisition:
A notice of NASA’s intent to award this sole-source action was synopsized on the GPE website (Sam.gov) per FAR Subpart 5.2 (See Section 6 above). The notice was published on July 6, 2023 for the fifteen (15) day posting requirement, and the industry was welcomed to challenge the sole source approach until July 21, 2023. That posting can be found at https://sam.gov/opp/190cdf0b782a4e318d37bec0684c68ca/view.
This posting informed potential sources of NASA’s intent to award this sole-source; the Contracting Officer did not receive any challenges of the Government’s intent to sole-source the requirement herein.
11. FAR 6.303-2(b)(11) – A statement of actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required:
None. Any future power supplies for NEAT must be this particular make and model in order to ensure maximum flexibility of the facility’s electrical power system.
