10K Dual Bridge Load Cell, Vented (Replacement based on Mike Oliver Evaluation, FMS not able to evaluate due to the non-standard connector on the load cells.

Recommend replacing the connectors on these load cells with the standard for the TMS.

Repair cost for each load cell includes recalibration.

Cost for replacing the load cell connectors with PT02E-12-10P connectors, the standards for the thrust stand. Price includes re-calibration.

6 3 FUL-PP49-OD-30K-89-129 30K Dual Bridge Load Cell with Integrated Flexures, Vented. Possibly one of the existing load cells can be repaired.

The estimated value of the full procurement is $319,755.00. The estimated period of performance is 12 months. The required parts have a long lead time since they are custom made to the 30 year old Ormond Inc MCT-87-129-40K Thrust Measurement System already in NASA’s possession.

4. FAR 6.303-2(b)(4) – An identification of the statutory authority permitting other than full and open competition:

The statutory authority permitting other than full and open competition is 10 U.S.C.

2304(c)(1), as implemented by FAR 6.302-1 Only one responsible source and no other supplies or services will satisfy agency requirements.

5. FAR 6.303-2(b)(5) – A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited:

The rationale supporting the use of 10 U.S.C. 2304(c)(1) is the unique qualities and build of the 30 year old Ormond Inc MCT-87-129-40K Thrust Measurement System described below.

Force Measurement Systems is the only company with the specialist labor skills and exclusive knowledge in order to manufacture replacement parts or fix the current parts of the thrust measurement system. The system on its own is highly specialized to NASA Glenn Research Center and is essential to complete mission goals and testing. Force Measurement Systems also employs individuals with an abundance of knowledge on the original Ormond Inc manufacturing processes making them uniquely qualified to produce the required parts.

These parts are custom and made to order but can only be produced using the data rights Force Measurement Systems owns regarding the Ormond Inc system. This justifies allowing the procurement to be sole sourced to Force Measurement Systems.

6. FAR 6.303-2(b)(6) – A description of the efforts made to ensure that offers are solicited from as many potential sources as practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies:

A notice to the Government Point of Entry (GPE) website (beta.sam.gov) was published on May 12, 2020, in accordance with FAR Subpart 5.2. This posting informed potential sources of NASA’s intent to award this sole-source 80GRC020P0017 to Force Measurement Systems. The results of this synopsis are summarized in Section 10 below.

7. FAR 6.303-2(b)(7) – A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable:

The Contracting Officer’s signature on this document indicates that the Contracting Officer has determined that the anticipated cost to the government will be fair and reasonable. The Contractor shall be required to submit a proposal to be evaluated and negotiated by the Government. Prior to execution of the contractual instrument, a proposal analysis will be performed. The proposal analysis will ensure that the final agreed-to price for the contract action is fair and reasonable. The proposed price will be determined fair and reasonable with a technical analysis. Since the parts are custom made they can only be compared to similar past purchases.

8. FAR 6.303-2(b)(8) – Description of the market research conducted, and the results, or a statement of the reasons a market research was not conducted:

A market research analysis report was completed for this procurement.

The intent to sole source was posted on sam.beta.gov to notify potential alternative offerors about the procurement.

The requester has extensive technical knowledge of the industry producing similar system parts. They have also purchased similar parts in the past.

An examination of agency-wide contracts and databases was searched.

General internet searches were conducted in order to explore possible new options.

9. FAR 6.303-2(b)(9) – Any other facts supporting the use of other than full and open competition:

Per FAR 6.303-2(b)(9)(i) the technical specifications for this procurement are not suitable for full and open competition because the Ormond system is older than any current parts being made commercially for similar systems. Force Measurement Systems is the only company capable of producing the necessary replacement parts that are compatible with the older system. The cost of alternatively replacing the Ormond system is far more costly to the government and not in its best interest.

10. FAR 6.303-2(b)(10) – A listing of the sources, if any, that expressed an interest in writing in the acquisition:

A notice of NASA’s intent to award this sole-source action was synopsized on the GPE website (beta.sam.gov) per FAR Subpart 5.2 (See Section 6 above). The synopsis was posted on May 12, 2020 and ended May 27, 2020. There were no responses to the synopsis.

11. FAR 6.303-2(b)(11) – A statement of actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required:

The Agency will continue to examine the market in the future for alternative solutions or new sources before executing any subsequent acquisitions for the same requirements.
