Justification for Other than Full and Open Competition Number 19- 16 U.S.C. 2304(c)(1) & FAR 6.302-1

1. The nature and/or description of the action being approved:

This justification provides the rationale for contracting by other than full and open competition for the acquisition of special information technology (IT) equipment to support NASA AFRC’s flight research programs.

2. Description of the supplies or services required, including an estimated value:

One each Compunetix 2 Slot Redundant Mobile Intercom System and ancillary support equipment required to support NASA AFRC’s Global Hawk ground communication system (GCS) intercom. The applicable communication system has a technical requirement to be compatible with and configurable to match the equipment being utilized at the Edwards Air Force Base (EAFB), Air Force Test Center (AFTC). The AFTC Mission Control Rooms (MCR) are being upgraded and configured with Compunetix communication equipment. Utilization of any other equipment will likely result in a substantial duplication of “cost and technical effort” that is not expected to be recovered through competitive acquisition procedures.

3. Statutory authority permitting other than full and open competition:

This requirement will be procured under statutory authority 10 U.S.C. 2304 (c) (1) and Federal Acquisition Regulation (FAR) 6.302-1, Only One Responsible Source and no other supplies or services meet agency requirements, which is modified to reflect the procedures in FAR Subpart 13.5 were used in accordance with 41 USC 1901.

4. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited:

The communication system has a technical requirement to be compatible with and configurable to match the equipment being utilized at the Edwards Air Force Base (EAFB), Air Force Test Center (AFTC). The AFTC Mission Control Rooms (MCR) are being upgraded and configured with Compunetix communication equipment. Utilization of any other equipment will likely result in a substantial duplication of “cost and technical effort” that is not expected to be recovered through competitive acquisition procedures.

5. Description of the efforts made to ensure that offers are solicited from as many potential sources as practicable, including whether a notice was or will be publicized as required by Federal Acquisition Regulation (FAR) 5.202:

This notice will be publicized on the Government wide point of entry (GPE) for a period of 15 days.

6. Description of the market research conducted, and the results, or a statement of the reasons market research was not conducted:

The Government performed market research to determine whether other vendors were capable of providing a system that would be compatible with the Air Force GCS intercom system and found that the differences between systems would not support the mixing of different vendor systems.

7. Other facts supporting the use of other than full and open competition.

None

8. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable

The Contracting Officer will make a fair and reasonable pricing determination by consulting with the Global Hawk GCS reconfiguration team to determine costs of similar systems.

9. Sources, if any, that expressed an interest, in writing, in the acquisition:

No sources have expressed an interest in this acquisition in writing.

This section will be updated if any other vendor expresses interest during the 15 day posting requirement on the GPE.

10. The actions that the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required:

The Government will continue to conduct market research to locate other potential sources for future requirements of this nature.
