Date: July 22, 2019 Solicitation # 75N95019Q00262

I. INTRODUCTION

THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A

CONTRACT OR PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION

(INCLUDING BRAND-NAME).

The National Institute on Drug Abuse (NIDA), NIDA Section, Contracts Management Branch Blue on behalf of the National Institute on Drug Abuse (NIDA), Intramural Research Program (IRP) intends to negotiate and award a or purchase order without providing for full and open competition (Including brand-name) to Lab Products Inc. , located at 742 Sussex Avenue, Seaford, DE 19973 to provide three (3) units of Enviro-Gard™ Multi-Plex™ Multi-rack Air Supply Handling Unit.

II. NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE

The intended procurement is classified under NAICS code 334516 - Analytical Laboratory Instrument Manufacturing with a business size standard classification of 1000 employees.

III. REGULATORY AUTHORITY

The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 2019-03 effective date 07-12-2019.

This acquisition is conducted under the procedures as prescribed in FAR subpart 13—Simplified Acquisition Procedures at an amount not exceeding the SAT.

IV. STATUTORY AUTHORITY

This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13—Simplified Acquisition Procedures, Subpart 13.106-1 (b) (1), Soliciting from a single source and is not expected to exceed the simplified acquisition threshold. Contracts awarded using FAR Part 13— Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6—Competition Requirements.

V. DESCRIPTION OF REQUIREMENT

1. Background NIDA Intramural Research Program purchased supply air blowers (and their individual ventilated cage racks) in response to growing research rodent populations and made refinements in animal welfare over the past twenty years. Many of these continuously operating (24x7x365) air blowers have reached the end of its functional lifespan and need replacement before failure.

The NIDA IRP provides personnel and materials to support a centrally administered program to house and care for research animals used by individual scientists. The Lab-Products, Inc., manufactured, Enviro-Gard™ Multi-Plex™ Multi-rack Air Supply Handling Unit provides conditioned vivarium housing room air to individual cages of rodents within NIDA IRP-owned, Lab-Products, Inc.-manufactured ventilated cage racks through a ceiling mounted ductwork to each of several ventilated cage racks within a given housing room.

Purchase of additional Enviro-Gard™ Multi-Plex™ Multi-rack Air Supply Handling Units, which are already owned and used by NIDA IRP, allows us to readily interchange units between different rooms and avoids the costs associated with redesign of HVAC ductwork and or electrical utilities to accomplish the objective through more expensive and disruptive, alternative means

2. Purpose and Objectives Enviro-Gard™ Multi-Plex™ Multi-rack HEPA Filtered Air Supply Handling Units are needed to replace groups of individual-rack supply air blowers which are not efficient and reaching the end of its functional lifespan. Multi-Rack units also improve the noise and vibration characteristics in the animals’ environment, an objective supported by the PHS Guide for the Care and Use of Laboratory Animals, in the face of the programmatic need to increase space utilization efficiency for a growing population of research rodents.

The Lab-Products, Inc., manufactured, Multi-rack Air Supply Handling Unit is engineered specifically to ventilate up to ten (10) Lab-Products, Inc., manufactured ventilated cage racks (VCR). Hence, the unit meets and does not exceed the air flow (in cubic feet per minute) requirements for a housing room which typically contains 8-10 VCRs, and the unit provides high quality, HEPA filtered air to remove particulate contaminants including pathogenic microorganisms supplied to the animals’ cages.

VI. CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-

NAME) DETERMINATION

The determination by the Government to award a contract without providing for full and open competition is based upon the market research conducted as prescribed in FAR Part 10—Market Research, Specifically, Med Associates, Inc. is the only vendor in the marketplace that can provide the services required by NIDA. The equipment is proprietary to its manufacturer, Med Associates, Inc. and this company is the sole provider of maintenance for this equipment. Med Associates, Inc.

has provided justification letter by stating that they are the sole source equipment manufacturer and service provider for these equipment. . The sole source determination is based on the fact that this is a follow-on to an existing project. The same system was used (other laboratory owns the system) to acquire the current data for this ongoing project. CPB lab is aiming to reproduce the data with small minor changes; therefore, they must continue to purchase the same system in order to avoid the introduction of new variables into the experimental results and to avoid long delays resulting from retesting of products from other potential suppliers. Consistency is critical to data validity, and CPB lab have to ensure that experimental protocols are maintained and unchanged for all studies performed, as any changes to the protocol could skew results and invalidate current work practices.
