About this file

This document is an Amendment 2 to a combined synopsis/solicitation for a Request for Quote (RFQ) related to mass spectrometry analysis of SARS-CoV2 antibody repertoire in 145 human plasma samples. The U.S. Food and Drug Administration's (FDA) National Center for Toxicological Research (NCTR) in Arkansas requires this analysis to be performed under a firm-fixed price contract, except for a time and materials line item for actual liquid nitrogen provided. The samples will be shipped by September 15, 2024, and the contractor shall deliver the results within 30 calendar days of receipt. The North American Industry Classification System (NAICS) code is 621511 - Medical Laboratories, with a small business size standard of $41.5 million. This is a full and open competition, but the Government will consider national security risks related to foreign entities processing Americans' genomic or plasma data. Past performance, technical capability, and price are the evaluation factors, with technical and past performance being more important than price. Offers are due by June 28, 2024.

Amendment 2 75F40124Q123714 14 of 33

The provision at FAR 52.212-1 Instructions to Offerors-Commercial Items (Sep 2023) applies to this solicitation. The following addenda have been added to this provision:

Addendum Paragraph (b):

Technical Capability/Risk (paragraph (b)(4): Will be determined by review of information submitted by the offeror which must provide sufficient technical information necessary for the Government to conclusively determine that the offered Mass spectrometry analysis of SARS-CoV‑2 antibody repertoire in human plasma samples whole exome sequencing (WES) of genomic DNA samples meets or exceed the technical requirements identified above. Offerors shall specifically address the performance specifications and support same with submitted technical specifications, descriptive material, literature, brochures, scientific publications where proposed solution has been used for same or similar purposes, and other information which demonstrates the capability of the offered solution at meeting or exceeding the stated needs of the FDA.

The Government's determination of technical acceptability in no way relinquishes the Awardee's contractual obligation to ensure the services meet the FDA’s stated need.

Provide (1) the place of performance for the services that process Americans’ plasma, genome or exome data (stored or transmitted electronically), to include a specification of whether that processing will occur through or in any foreign country or entity, (2) whether the genome or exome will be provided to any other country or entity, or (3) whether any information technology capabilities used to receive, process, or respond to this contract, to include but not limited to servers, data storage, cloud storage, or analytics tools, are located in any foreign country or entity.

For each reference include a brief description of service performed, contract number(s), dollar value, client points of contact names, and client points of contact email addresses and phone numbers. The Government reserves the right to look to other sources of information (e.g., the Contractor Performance Assessment Reporting System (CPARS), etc.) to support past performance evaluations. Respondents who do not provide a valid email address for the client POC or without a relevant record of past performance or for whom information on current or past performance is not available will not be evaluated favorably or unfavorably. Favorable past performance is considered higher than neutral past performance.

Price: Provide detailed price quote for each item proposed to meet the Schedule of Items.

Price shall be detailed and supported by a breakdown of all items required. (Offerors shall fill in the schedule above with the total prices and provide a detailed quote in their own format.) Include the firm’s SAM Unique Entity ID (UEI) number with quote.

Any proprietary information shall be marked as such. Technical capability and past performance for any intended subcontractors shall be included with offer.

Amendment 2 75F40124Q123714 15 of 33

The Quoter shall submit a written Accessibility Conformance Report (ACR) for each item not in compliance with 508 standards identified in clause 352.239-74, describing how the item(s) will fully address the accessibility requirements outlined in the solicitation; and a description of the evaluation methods the offeror will use to validate for conformance to the Revised 508 Standards. The ACR should be based on the Voluntary Product Accessibility Template Version 2.0 (MS Word) provided by the Industry Technology Industry Council (ITIC). For this requirement we anticipate only records and reports and invoices to be applicable to the requirement

NOTE: Submission of the ACR is required for documentation purposes. In accordance with agency purchasing procedures, solutions which do not conform fully to the applicable 508 standards may still be purchased by FDA if the FDA Requiring Office obtains the appropriate approval. In order to obtain approval, the FDA must have an ACR from the vendor documenting the level of conformance of the items being purchased.

The government is not responsible for locating or securing any information, which is not identified in the proposal however the Government reserves the right to obtain information for use in the evaluation from any and all sources including sources outside of the Government. The Government reserves the right to request additional information from a quoter at any time.

When submitting proposals via email, DO NOT include .exe, .mso, or any other executable file types that could potentially trigger email security protections (i.e. email blocks, quarantine). If the offeror or applicant submits documents that contain macros, macro referenced files, and/or executable files, the Government will not be able to view or open such documents and the submission will be considered non-responsive to the solicitation. No additional time will be given to an offeror or applicant to correct the document submission and the Government will not inform the offeror or applicant that their submission is non-responsive prior to award. It is the offeror’s or applicant’s responsibility to ensure all electronic documents are submitted without the use of macros.

The provision at FAR 52.212-2 Evaluation-Commercial Items (NOV 2021) is applicable to this solicitation. The specific evaluation criteria to be included in paragraph (a) of that provision are

Amendment 2 75F40124Q123714 16 of 33 as follows:

Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(i) Technical Capability/Risk (see FAR Provision 52.212-1 (b)(4) and addenda thereto). As part of the technical capability the national security risk to the Government will also be considered for entities that process Americans’ plasma, genome or exome data in any foreign country or entity or potentially provide that information to a foreign country or other foreign entities. The national security risks related to sharing genomic (including human plasma) data will be considered in the trade-off award decision. The Federal Bureau of Investigation (FBI) has identified national security risks that could undermine U.S. companies and steal intellectual property and trade secrets related to sharing genomic data, and recognizes foreign countries and entities as a primary source of those risks.

(ii) Past Performance (see FAR Provision 52.212-1 (b)(10) and addenda thereto)

(iii) Price

Technical Capability/Risk (i.e., how well the proposed service will meet or exceed the Government’s requirements), past performance (i.e. when, what and how well), and when combined is significantly more important than price in determining the best value to the government. However, if the Government determines non-price factors to be essentially equal among competing offerors price becomes more important as a discriminating factor.

The Government reserves the right to request additional information or conduct discussions at any time. Once the Government determines the offeror that is the best-suited (i.e., the apparent successful offeror), the Government reserves the right to communicate with only that offeror to address any remaining issues, if necessary, and finalize a contract with that offeror. These issues may include technical, price or other issues.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

The Provision at FAR 52.212-3, Offeror Representations and Certifications-Commercial Products and Commercial Services (May 2024), applies to this acquisition.

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual

Amendment 2 75F40124Q123714 17 of 33 representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v) of this provision.

(a) Definitions. As used in this provision— "Covered telecommunications equipment or services" has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

Economically disadvantaged women-owned small business (EDWOSB) concern means a small business concern that is at least 51 percent…
