5Please clarify whether, by operation of the solicitation and resulting contract, title and/or any ownership rights to data, products, records, files, analyses, models, documents, or other property would transfer to and/or vest in the government. If so, please identify the provision of the solicitation that dictates such a result.Yes. The government shall have unlimited rights as defined at 52.227-14 and para. C.10.
6Please clarify the intended scope and applicability of the IT Security provisions (pages 9-13 of the solicitation). Does the CDC anticipate that contractors will (1) have physical or logical access to government information and/or (2) operate a federal system containing data that supports the HHS mission? What government information and information systems will contractors be obligated to protect if awarded a contract? Please define the terms “HHS data” and “HHS information” as they appear on pages 9 and 10 (page 9, paragraph (a) under “IT Security”; page 10, paragraph (a) under “Standard for Encryption Language”) of the solicitation.(1) No. (2) No. There is no sensitive data. The IT Security language is included in the solicitation through the internal ISSO clearance process to protect the government from data breach responsibility. There is no sensitive data covered under the solicitation and the expectation is that the vendor’s commercial system (i.e. SharePoint Online) may be utilized. The data being collected is for shipping and commercial processing which is a normal course of business. The only other data are the HHS approved questions that allows the government to prioritize distribution of the kits. This data is accessible on the same portal as the commercial info for the government. All of the contractor data is being used in their normal commercial data management platforms.
7Is the CDC able to be listed a reference for previous or similar work?Yes.
8Page 69I noticed section (b) Cost Data Information on page 69 of the solicitation document and am not sure what information is required. Our understanding is that the IDIQ facilitates Task Orders which will have costs based on the items (deliverable) required under each Task Order. With that being the case, why are labor rates, indirect costs and facility costs required as part of the Business Proposal (Volume II)? Any information on this and if these are required, examples of what information is required would be very useful.Reference is made to Attachment J3 which will establish the necessary labor categories anticipated for orders placed under the Basic contract. Reference is made to Attachment J4 which will establish labor rates anticipated for any orders issued for the duration of the contract. Attachments J5 and J6 are for pricing purposes. Any costs proposed should be clearly delineated with your proposal for these task orders utilizing the labor categories and rates noted in Attachment J3 and J4.
