Subject: Questions in Response to Solicitation 75D301-19-R-76848
1. An extension was requested.
Answer: The due date has been extended to January 24th at 9:00 AM EST.
2. Are small disadvantaged business wholesale businesses, having Authorized Wholesaler/Distribution Agreements in place with the approved vaccine manufacturers, are eligible to be awarded of the 2019 VFC IDIQ as a authorized non-manufacturer distributor?
Answer: Thank you for the proposal you submitted in response to solicitation #75D301-19-R-67848. This solicitation was a request for bids as part of CDC’s Vaccines for Children Program, which was created under Section 1928 of the Social Security Act (42U.S.C., Section 1396s).
This statute, https://www.ssa.gov/OP_Home/ssact/title19/1928.htm , specifies in subsection (d)(1) that the Secretary “shall negotiate and enter into contracts with manufacturers of pediatric vaccines (italics added). . .” and further defines manufacturers in subsection (h)(4) as a “corporation, organization, or institution, whether public or private (including Federal, State, and local departments, agencies, and instrumentalities), which manufactures, imports, processes, or distributes under its label any pediatric vaccine (italics added).”
Following consultation with CDC’s attorneys, and based on this definition, your organization does not qualify to submit a bid for contract to the Vaccines for Children Program.
