JUSTIFICATION FOR SOLE SOURCE PROCUREMENT (OPEN

MARKET OR GSA) UNDER $150,000

Sole source acquisitions may be used on a limited basis and only when the Contracting Officer’s Representative (COR)/Program Official has provided sufficient justification and the Contracting Officer has determined that the circumstances warrant such action. The content for a justification must contain detailed facts and rationale to justify the sole source acquisition. Soliciting from a single source must be done in accordance with FAR 13.106-1(b) or 8.405-6. At a minimum, the following information must be included:

1. The justification for this non-competitive action is: (NOTE: Must select only ONE of the listed justifications for other than full and open competition and fully support the justification in the following paragraphs. Please delete this note prior to submitting the justification.)

☒ In accordance with FAR 13.106-1(b)(1), “only one source [is] reasonably available” which states that, “For purchases not exceeding the simplified acquisition threshold. (i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization). (ii) Where a single source is identified to provide a portion of a purchase because that portion of the purchase specifies a particular brand-name item, the documentation in paragraph (b)(1)(i) of this section only applies to the portion of the purchase requiring brand-name item. The documentation should state it is covering only the portion of the acquisition which is brand- name.”

2. Other facts supporting sole source procurement:

a. What can this product/service do that other products/services cannot do?

The Dragonfly Discovery assay development instrument offers extremely accurate pipetting of volumes between 0.2 ul- 4 mL. This compact liquid handler is smaller than most liquid handling systems and can handle a wide range of liquid types with no requirement for liquid classification. The Dragonfly family of instruments are the only liquid dispensers using true positive displacement of liquids for aspiration and non-contact dispensing. As the Dragonfly has unique positive displacement tips, there is no routine calibration needed. It has very low working and dead volumes so that expensive reagents are not lost. The Dragonfly also operates at high-speed and is capable of bulk filling a 384-well plate in <30 seconds. It will also integrate with other instruments that we currently use. TTP Lab tech Ltd is the sole producer and distributor of the Dragonfly Discovery instrument.

b. What other products/services were considered and why did they not meet the need?

The Influenza Genomics Team currently has a Hamilton Starlet and Perkin Elmer Zephyr. However the size and speed of the Hamilton Starlet is problematic for the lab space. The Hamilton Starlet is a large and bulky instrument and only has a 4-channel pipetting capability. The Zephyr also has a large footprint and does not handle the wide ranges of volumes without modifications. The biggest reason that the Dragonfly Discovery is desired over all other liquid handlers accurate liquid dispensing is due to the instruments unique ability to accurately pipet a range of volumes from 0.2ul to 4mL without the need to adjust or change anything on the instrument. This benefit, allows those doing genetic sequencing to save significant

The Influenza Genomics Team currently uses a competitors’ instrument for liquid dispensing and are aware of the capabilities of both the Hamilton Starlet and Perkin Elmer Zephyr.

Internet searches were done on the capabilities of other liquid dispensing systems that we do not currently use. GSA advantage was searched to see if the Dragonfly Discovery was available for purchase there.
