AVAILABILITY OF FUNDS FOR THE NEXT FISCAL YEAR (APR 1984)

Funds are not presently available for performance under this contract beyond 30-SEP-2024. The Government's obligation for performance of this contract beyond that date is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise for performance under this contract beyond 30-SEP-2024, until funds are made available to the Contracting Officer for performance and until the Contractor receives notice of availability, to be confirmed in writing by the Contracting Officer.

Addendum to FAR Provision 52.212-1

(b) Submission of Offers. – Tailored

(1) Submit signed and dated quotes via e-mail to the Contracting Officer and Contract Specialist specified in this solicitation at or before the exact time specified in this solicitation. Quotes shall be submitted in the English language and U.S. dollars.

Quoters are required to include a completed copy of the provision at 52.212-3 Offeror Representations and Certifications – Commercial Items, Alternate I of 52.212-3. Quotes shall include a Cover Letter, Price Schedule and the required Past Performance and Technical Capability submission documentation in accordance with the below instructions:

(i) Cover Letter: Quoters shall submit a Cover Letter (on company letterhead stationery) that is dated and signed by an Authorized Official of the Quoter that includes the following information as a minimum:

· Solicitation Number 70Z08024QPBPL0039;

· The time specified in the solicitation for receipt of quotes;

· The Name, Address, Telephone Number, SAM Unique Entity Identifier (UEI), and CAGE Code of the quoter;

· Name, Title, Phone Number, and E-mail Address of an Authorized Official of the Contractor;

· The date/time the quote expires (which shall be at least 90 calendar days from the date specified for receipt of quotes, unless another time period is specified in an amendment to the solicitation.);

· Acknowledgment all Solicitation Amendments; and

· A statement specifying the following agreement: "Our Company agrees with all the terms, conditions, clauses, and provisions included in Solicitation 70Z08024QPBPL0039."

(ii) Price Schedule.

Growth Work: Growth work is defined as additional work discovered during contract performance that is associated with an existing work item and determined necessary to accomplish the original scope of that work item successfully. The Contractor shall not perform any growth work without the Contracting Officer's authorization. The contractor must be able to absorb growth within the ship's availability. Changes are inherent to vessel repair contracts and should be expected by Contractors.

The contractor's proposed labor rate and the proposed material percentage will be used for change requests negotiated during the performance of contract as a result of growth. The number of growth labor hours and the material base amount found in the pricing schedule are estimates that are generated for evaluation purposes only.

Quoters shall complete Attachment 1, Schedule of Services and include it in their quote. The Contract Line Item Numbers (CLINs) assigned by the Government shall not be altered by quoters.

If the Contracting Officer cannot determine whether a quoted price is fair and reasonable, then the Contracting Officer may require a Quoter to submit data other than certified cost or pricing data to support further analysis. This data may include history of sales to non-governmental and governmental entities, cost data, or any other information the Contracting Officer requires to determine the prices fair and reasonable.

Notice to Offeror(s): Funds are not presently available for this effort. No award will be made under this solicitation until funds are available. The Government reserves the right to cancel this solicitation, either before or after the closing date. In the event the Government cancels this solicitation, the Government has no obligation to reimburse an offeror for any costs.

(iii) Past Performance Submission

The quoter shall identify up to three (3) recent and relevant contracts or efforts as past performance references. Recent and relevant past performance is defined as similar work being performed within three (3) years of the posting of the solicitation. Quoters should provide a detailed explanation demonstrating the relevance of the contracts or efforts to the requirements of the solicitation.

The quoter should provide the following information for each reference submitted.

· Name of Quoter

· Contract Number, Order Number, or Identifier

· Customer Name and Location

· Customer Point of Contact (Name and Title)

· Telephone and e-mail address of Customer Point of Contact

· Contract Period of Performance

(iv) Technical Capability Submission

The quoter shall address the following items in their technical capability submission-

Technical Approach:

Submit a legible planning document (graphical in format) in accordance with SFLC Std Spec 0000 that outlines the strategy to ensure this requirement is completed on or before the contract completion date. The planning document shall include the following characteristics:

1) Proposed schedule, resources, and shows overall period of performance for each CLIN including start and stop dates of major sub tasks within each CLIN including CFR submittals. Contains due dates for Critical inspection reports (CIR) if required by the specification.

2) Identify the critical paths for the project. Show calculations for the float along the critical path, indicating number of delay days the critical path can absorb without affecting the final delivery date.

3) Identify a list of items that may pose the most contract schedule risk and approach to mitigate or eliminate each risk.

Coatings Certification Requirements

Submit a description of how you intend to meet SFLC Standard Specification 0000 coatings QC/QA requirements for this contract. This plan must include the resumes and certifications for any proposed QP1 certified painters and/or the name of the NACE CIP level 3 certified Tech rep along with certificate number.

MTU 20V4000 Engine Maintenance Qualification/Experience Requirements:Submit the name and resume of the technical representative performing maintenance and personnel engaged in the supervision of the alignment work. The technical representative shall have experience with MTU marine engines documented on their resume. Personnel engaged in the

LNSorrell Highlight supervision of the alignment work shall have their experience with engine and reduction gear system documented on their resume.

Welding Certifications/Procedures

Submit welding documentation in accordance with SFLC Standard Specification 0740 specific to your internal or subcontracted staff for the weld joints that will be installed. Documentation shall include welding procedure specifications (WPS) applicable to the solicitation, Welder certification documentation including welder name and WPS(s) certified to perform, and welder continuity documentation which provides proof of proper certification maintenance.

Fire Safety Plan: Submit a brief description of how you intend to meet Fire Detection/Alarm/Response requirements outlined in SFLC STD SPEC 5550 and para 3.1.1.1.3 of the General Requirements Work Item. At a minimum, address the following:-What temporary measures will be taken (e.g. temp installation of a contractor furnished and owned systems, hook up of temp external power to the vessel's installed systems, etc.) to supplement any loss of the vessel's fire detection/alarm, fire-fighting, and shipboard lighting and communication systems.-Who will fight a fire on the vessel, and how will they be notified of a fire.-Given the scope of work, what are the anticipated breaches of the cutter's fire protection boundaries (e.g. hull access cuts needed, hull fittings that will be impacted by vessel work, etc.)-How will the risk caused by the anticipated breaches be mitigated (e.g. removal of cables/hoses/etc. at the end of each work day or installation of quick disconnects, installation of temporary fire curtains, etc.)

(2) General Instructions/Information.

(i) Quoters are expected to examine the entire solicitation (including any exhibits and attachments), and any amendments to this solicitation. Quotes shall be prepared in accordance with these instructions, providing all required information in the format specified. The Quoter shall confine submissions to essential matters, sufficient to define the quote details, in a concise manner, to permit a complete and accurate evaluation of each quote. Proprietary information shall be clearly marked.

(ii) Quoters shall furnish all of the information required by this Solicitation; quotes that fail to furnish required representations or information/documents, fails to meet any of the requirements of the Solicitation, or reject the terms and conditions of the solicitation may be excluded from consideration.

(iii) This Solicitation does not obligate the Government to compensate for any costs incurred by the Quoter in the preparation and/or submission of any quote, nor does it obligate the Government to procure for said supplies.

(c) Period for Acceptance of Offers. – Tailored

The quoter agrees to hold the prices in its quote firm for 90 calendar days from the date specified for receipt of quotes, unless another time period is specified in an addendum to the solicitation.

(g) Contract award (not applicable to Invitation for Bids.) – Tailored

The Government intends to evaluate quotes and award a contract without exchanges with quoters. Therefore, the quoter's initial quote shall contain the quoter's best terms from a price and technical standpoint. The Government reserves the right to conduct exchanges with all or some of the quoters or with only the best-suited quoter (i.e., the apparent successful quoter), if later determined by the Contracting Officer to be necessary. The Government may reject any or all quotes if such action is in the public interest; accept other than the lowest quote; and waive informalities and minor irregularities in quotes received.

(l) A Brief Explanation of the Basis for the Contract Award Decision. – Tailored

If a quoter requests information on an award that was based on factors other than price alone, a brief explanation of the basis for the contract award decision shall be provided.
