Justification for Brand Name Mandatory for Acquisitions under $1 SOK

a. Five (05) Hatches, Marine; PIN: 1 IOCWPB-167-013, NSN: 2040-01-298-5741 used on the 11 O' WPB Coastal Patrol Boats.
b . Five (05) Doors, Marine; PIN: 110CWPB-167-006LH, NSN: 2040-01-304-4291 used on the 11 O' WPB Coastal Patrol Boats.

7. Impact Statement:
The Doors and Hatches listed in this JOTFOC is the standard issue currently being installed on the 110' WPB's . The original equipment manufacturer (OEM) of the Doors and Hatches, Marine is Advantec MFG Freeman Marine. The Door and Hatch, Marine must conform to size, materials, mounting and operating requirements . The 110' WPB vessels have mandated standard configuration requirements so other vendors' Door and Hatch, Marine may not meet this requirement.
The 11 O' WPB cutters routinely operate in bad weather and heavy sea state conditions during nonnal operations. These operations include search and rescue, maritime law enforcement, illegal migration prevention and homeland security missions in international and territorial waters. The Door and Hatch, Marine currently installed and identified in this acquisition was tested to meet the existing vessel manufacturer requirements and specifications. The failure of any Door and Hatch, Marine during active operations could cause personal injmy as well damage from water intrusion and possible flooding, premature metal failure due to corrosion or failure to meet unit mission requirements. The reliability of the Advantec MFG Freeman Marine Door and Hatch, Marine is known and acceptable; they have met Coast Guard mission requirements and safety standards through nearly a decade and a half of unrestricted use and thousands of operational hours. There are other Door and Hatch, Marine, available, however determining the equivalency of a non- Freeman Marine Equipment Inc Door and Hatch, Marine will require operational testing, design reviews and system/sub-system re engineering to determine their suitability. This eff011 will require costs that would be diverted from other logistics elements which then would impact other support areas for the 11 O' WPB. Failing to perform these additional efforts and accepting without evaluation a so called equivalent Door and Hatch, Marine is unacceptable and may result in potential personal injuries, reduced reliability, reduced safety, increased maintainability and increased logistical costs which will impact Coast Guard mission requirements.
8. Explain why an adequate purchase description or other information suitable to solicit by Full and Open Competition has not been developed or are not suitable.
All reproduction manufacturing drawings, specifications, and other technical data pe11aining to the Advantec MFG Freeman Marine Door and Hatch, Marine were not purchased by the Coast Guard and are not available for use by the Coast Guard now. The Coast Guard does not possess manufacturing data required to obtain full and open competition. Furthermore, the scope of manufacturing, special tools and equipment required to manufacture the Advantec MFG Freeman Marine Door and Hatch, Marine are unknown. The technical data needed is proprietary. Without the adequate data, the Coast Guard is not capable of evaluating an equal or alternate Door and Hatch, Marine manufactured by other than the OEM. The use of the OEM Hatches will ensure components and processes are sufficient to enable physical and functional interchangeability, as well as identifying source, size, configuration and performance requirements. Vendors other than OEM shall provide documentation certifying the Door and Hatch, Maiine meet OEM specifications and standards and they pertain to the 110' WPB Patrol Vessels.
9. Provide a Statement of Actions, if any~ the-government may take to remove or overcome any barriers to competition before future acquisitions are required.
The COR will conduct market research with a focus on finding multiple sources for future procurement of this item, however without the proprietary data mentioned above this will be difficult.
