The United States Coast Guard (USCG), Aviation Logistics Center (ALC), Medium Range Recovery (MRR) Product Line intends to award a TT&E to determine a firm-fixed price repair order. The statutory authority permitting other than full and open competition is 4l U.S.C. l90l(c), as implemented in FAR 13.106-l(b) (l).

BRIEF DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED, AND THE INTENDED USE,

MRR intends to TT&E/repair the item shown in the table below on a sole source basis and require that vendors provide traceability to the Original Equipment Manufacturer (OEM) if they are not the OEM or an authorized distributor of the OEM. The TT&E/repair of the Bomb Racks are limited to Marvin Engineering and any Marvin Engineering authorized repair facilities.

Quantity Optional Quantity Part Number (P/N) Nomenclature 19 each 20 549AS400 I -l Bomb Rack

The Bornb Racks are utilized on the H60 aircraft and are being replaced during inspection due to damage and/or corrosion.

UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER SUPPLIES OR SERVICES

CAN BE USED.

The items to be TT&E to deterrnine repair under this acquisition is a highly specialized part, which has been designed and manufactured by Marvin Engineering (Cage Code 32067). As the OEM of this item, Marvin Engineering owns all rights to the technical data, specifications, and drawings required for manufacture and/or repair. The rights to the technical data necessary in order to repair this item are not owned by the Government and it has been determined that it is uneconomical to purchase these rights.

A DESCRIPTION OF EFFORTS MADE TO ENSURE THAT QUOTATIONS OR OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES

AS PRACTICABLE (TNCLUDE YOUR MARKET RESEARCH EFFORTS HERE).

Extensive market research was conducted using both Government and commercial sources. This included querying the following information systems and web sites: Defense Logistics Agency (DLA) Federal Logistics Information Service (WebFLIS); Federal Electronic Mall (Fedmall); the General Services Administration's (GSA) online purchasing service - GSA Advantage@; Inventory Locator Service e-marketplace (lLSmart); internet search engines; and the OEM's web site.

This item is not available from any required or optional source of supply IAW FAR 8.002. Several authorized cornmercial distributors were identified in addition to the OEM. A combined synopsis/solicitation will be posted to the Federal

Business Opportunities (FBO) web site at wrvrv.fbo.gov IAW FAR 5. I 0l(a)( I ). The OEM and authorized distributors will be notified of this posting to FBO.

REASON THATSUGGESTED SOURCE IS THE ONLY SOURCE WHICH CAN PROVIDE THE SUPPLIES OR SERVICES.

Marvin Engineering is the OEM and they own the rights to the technical data, specifications, and drawings required to repair this item. An alternate source must qualit/ in accordance with the design control activity's procedures, as approved by the cognizant Government engineering activity. The USCG is conducting a sole source TT&E/Repair acquisition. Any offeror that is able to provide the TT&E lrepair other than the OEM need to demonstrate that they are a distributor officially authorized by the OEM in order to be consider for award.

EXPLAIN WHY AN ADEQUATE PURCHASE DESCRIPTION OR OTHER INFORMATION SUITABLE TO SOLICIT BY FULL AND OPEN

COMPETITION HAS NOT BEEN DEVELOPED OR ARE NOT AVAILABLE.

The part to be procured is complex and must meet critical operational and reliability requirements, the achievement of which require unique production techniques and extensive and/or sophisticated testing. The Government does not own or possess any rights to the technical data, specifications, and drawings required to manufacture this item and it has been determined that it is uneconomical to purchase them. In addition, the Covernment has not developed the technical data required to manufacture this part and has no plans to do so.

PROVIDE A STATEMENT OF ACTIONS, IF ANY, THE GOVERNMENT MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO

COMPETITION BEFORE FUTURE ACQUISITIONS ARE REQUIRED.

As previously stated, the Government does not own or possess any rights to the technical data, specifications and drawings required to manufacture this item which has prevented the USCG from being able to provide an adequate technical description to potential new sources. Therefore, it is difficult to take steps to foster competition when the manufacturing, performance, and acceptance data are proprietary to the OEM.
