4. Identification of statutory authority permitting other than full and open competition.
The statutory authority permitting other than full and open competition is 41 U.S.C. 3304(a)(1) pursuant to FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Demonstration that the nature of the acquisition requires use of the authority cited.
a. DHS/ MGMT/FPS leases law enforcement vehicles from GSA. In FY2016 and prior, GSA provided the law enforcement mobile radios and installation as part of the vehicle lease. In FY2017, GSA notified FPS after the order for vehicles had been submitted that they would no longer provide the radios. FPS intends to procure up to 793 Motorola Dual Band High Power Radios and Accessories during the life of this BPA through issuing task orders over next four (4) years.
b. Ford Motor Company Dearborn MI (Ford) and FIAT Chrysler Automobiles (FCA) manufactured Law Enforcement (LE) vehicles for GSA. Auto Truck Group (ATG), 1420 Brewster Creek Boulevard, Bartlett, IL, 60103, subcontracted with Ford and FCA to complete the upfitting process. The GSA upfitting package includes:
• Emergency lighting and PA system,
• Radio wiring, portable radio charger and mounts, sirens,
• Center Console Provisions to accept additional equipment,
• Laptop Mounting,
• Weapons Mount and Gun Box,
• Anti-Theft System,
• Rear Cargo Mount/Equipment Tray,
• Prisoner Partition,
• Exterior Markings (decals),
• K9 package (K9 platform with window guard, temperature monitor, alarm, fan, shroud, and control module
Installation of the radios, decals, and installation and procurement of tonneau covers other than those deemed a part of a specific package are not included in the upfit package. GSA has agreed to allow FPS to contract to have them installed during the upfit process if ATG is used in accordance with GSA’s established contractual agreements.
c. If FPS contracted with a vendor other than ATG for radio installation, Ford &
FCA would be legally within the bounds of the contract to: protest, terminate their agreement with ATG, and/or void all warranties provided to GSA for those vehicles leased and modified by FPS through an alternative source.
d. As a result of the contractual agreements established by the GSA, ATG is the only one responsible source and no other supplies or services will satisfy agency
- 4 -requirements without invalidating the manufacturer’s and GSA warranty/liability on the upfitted vehicles.
e. If this J&A is not approved and, consequently, the service not provided, FPS will have to ship radios to multiple Regional locations and coordinate the radio installation at 48 geographically dispersed marshalling yards. In addition, FPS would have to coordinate with multiple parties in a decentralized manner thus leading to additional program costs including: radio/vehicle storage fees, double lease charges, and costs associated with managing two (2) different vendors for warranty (upfit and radio installation).
6. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. DHS/CISA/FPS intends to make this justification publicly available pursuant to FAR 6.305 on FedBizOpps.
7. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable. The Contracting Officer determines that the anticipated price(s) will be fair and reasonable based on the pricing information received on the previous similar contract no. 70RFP318PEH000006 awarded on 7/30/2018 and based on the rates provided to the GSA via a subcontract with Ford & FCA.
8. Description of market research. Market Research on upfitting of LE vehicles, particularly the installation of radios, was conducted using GSA Schedule 23V Automotive Superstore, Category: 190 07 – Upfitting of Government-owned Emergency Response Vehicles to provide Turn-Key Solutions. The market research confirms that ATG is the only source that can complete the radio installations in one (1) centralized location during the upfitting process.
9. Any other facts supporting the use of other than full and open competition. Failure to install the radios and accessories into the GSA leased Law Enforcement vehicles will result in a 4% FPS Law Enforcement degradation of capabilities. If the vehicles do not have the mobile radios installed, they will not be available for law enforcement use which will severely degrade FPS’s ability to provide law enforcement and security to over 9,000 federal facilities, workforce, and visitors. Further, if the radios are not installed during the upfitting process, FPS will have to ship radios to multiple Regional locations and coordinate the installations at 48 geographically dispersed marshalling yards.
10. A listing of the sources, if any that expressed, in writing, an interest in the acquisition.
No other souces have expressed interest in this acquisition.
11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for supplies or services required.
To address the issue of competition for the installation of the mobile radios, DHS/CISA/FPS will work closely with GSA in the design and lead time development for future model year vehicles, with the intent of amending future lease agreements to include radio installation.

12. Contracting Officer’s Certification. I certify that the data supporting the recommended use of other than full and open competition is accurate and complete to the best of my knowledge and belief.
Contracting Officer Date
13. Technical/Requirements Personnel Certification. I certify this requirement meets the Government’s minimum need and that the supporting data, which forms a basis for this justification, is complete and accurate.
