No, the Post orders will be clearly defined in the Guard Request Order Form issued for the initial assignments/posts.

There is no required hours for orientation for guards. The FEMA Security Manager will provide a short overview of the expectations of the Post Orders to security officer standing post.

The Requirements in FAR 52.222‐17 Nondisplacement of Qualified Workers (May 2014) are being discussed with the Federal Protective Service (FPS) to provide such information to the successful offeror.

The paragraphing in this section makes it difficult to discern FEMA's meaning. Can FEMA clarify or confirm what vehicles are required as ATV's are mentioned in para 9.i and 9.v. Are ATV's required for up to 10% of the security sites?

No. Valid proof of all training certification/re‐ certification should be currently dated and within the requirements of the States/Commonwealth laws.

The SOW does not provide any breakdown of Contract A or B in terms of how many guards/guard hours are required for the specific types of facilities (such as JFO, DRC etc.) It only provides an estimate of hours for evaluation. Is there are minimum guarantee of hours that can be used as a divisor for fixed costs such as overhead managers and supervisors.

Without a more accurate hours estimate, FTE's are difficult to estimate, and thus transition items such as uniforms, firearms, etc. cannot be estimated when any accuracy. What happens if a contractor proposes the 100 initial guards required on day one, and the contract ends up with 400? How is the contractor reimbursed?

The contractor must proposed transition costs based on its estimates and is to include other costs in the proposed hourly rate.

No. CPR/AED certificates are required with the training certificate.

II. Phase‐Out of Contract and Continuity of Services

How long is the conctract? What are the start/completion dates?

The contract will begin on the date of the award and will consist of a 90 day base period with three (3) 90 day option periods for a total period of performance of 12 months

In order to compute guard staff requirements for relief officers, we need to no how many posts require physical relief per day. Also, we need to know if guards can take an "on duty" break for "personal relief/rest room break", or an on duty lunch; and, whether a roving patrol officer in a multi‐officer site can relieve another officer for a break or for lunch?

Most sites have at least 2 security guards and one can perform the duties while the other is on break/lunch. If necessary to allow for breaks, the Government includes a rover in the Security Guard Work Order issued to the contractor.

No. A physical exam should be a requirement of the state licensing or company policies.

This paragraph does not mention that pre/post employment drug screening (or random drug screening) is required: these are mentioned in paragraph 8.iii on page 17, but "random" screening is not; Assuming pre/post drug screens are required, are the "post" employment drug screens random or a one‐ time event? If random, what percentage of the guard force should be tested?

The contractor is responsible for compliance with all Federal, Commonwealth of PR and local requirements and enforcement and execution of their own company policies regarding drug screening.

General 24/7 posts How many sites are 24/7 sites? What is the size of the staff on these sites and how many are on each shift?

DRC's are normally 2 guards and could range from 24 hour shifts or 12 hour shift. Approximately 40/50 Sites are 24/7; Sites are depending on the requirements which are unknown. See Attachment ‐ Site Locations and Active Guards 12.08.2017 for more details.

It would be beneficial to conduct on‐the‐job training, for examle a certain number of hours shadowing an experienced guard on an unfamiliar post (the number of hours would be determined by the COR); however, due to the uncertainty of post rotation, could the OJT hours be billable to reduce overall costs? (If contractors simply bid "x" hours OJT per new hire, that would be reduced if the hours were specified by the COR and billable; it would also reduce initial guard mount time to become familiar with a post upon first assignment thereto.)

There is no required hours for orientation or OJT.

However, the Security Manager will provide a short overview of the expectations of the Post Orders to security officer standing post. During shift change, the Off going Security Guard should be providing a brief synopis of the shift events or concerns to the next shift arriving in a written report or via verbal communication. I would think a shift report would be appropriate documentation.

Yes. All licenses requirements are the responsibility of the Company and they are responsible for researching what the requirements are for each county/state/commonwealth requirements.

The quantity of hours provided are for evaluation purposes and are not guaranteed. The quantity of hours does not represent a minimum or a maximum and will not be split any further than how it is has been split between contracts A and B.

Does the Puerto Rico Labor Act No 379 that provides that the regular work shift for non‐exempt employees is one of eight hours per day and a regular workweek is 40 hours. Any work performed in excess of these limits will be considered overtime work and must be compensated accordingly.

The contractor must comply with all Commonwealth and local laws.

Does the Puerto Rico Labor Act No 379 of May 15, 1948, P.R. Laws Ann. tit. 29, §283, which requires an employer to grant all non‐exempt employees (such as guards) a meal period commencing not before the end of the third hour of work and not later than before the beginning of the sixth hour of work. An employee should never be required to work more than five consecutive hours without pausing for a meal period.

If an employee is required or permitted to work during his or her meal period, or if the period is enjoyed outside the time frame mentioned above, the employee will be entitled to payment at twice his or her regular rate. This penalty is independent of overtime requirements. If this is the case will the guard company be required to provide a relief?

The contractor must comply with all Commonwealth and local laws.

All guards are expected to be on post at the appointed time. If your company requires the guards to be on post prior to the official start time as part of your Quality Assurance, at not cost to the Government, that is fine. All relevant information can be passed from offgoing guard quickly to the oncoming guard.

Item B states To comply with the Health Insurance Portability & Accountability Act (HIPPA), the Medical Evaluation (SF‐78_ may be filed separately by the contractor. Question: Does each individual guard need an SF‐78 form? Does the SF‐78 need to be filled out by a local Puerto Rico doctor? Does the SF‐78s need to be completed prior to a guard assuming a post? If not what is the time frame for compliance?

This requirement is up to the contractors discretion.

All requirements for the SF‐78 have to be researched by the companies, but will not affect a guard's ability to assume a post.

Statement of Work / Section 9 Patrol and Response

What are the proposed quantity of ATVs, 4x4 vehicles and guard shacks required? What is the average mileages the ATV and the 4x4 vehcile will be required to travel per shift? Is the Government going to be able to provide fuel if not readily available on parts of the island?

It was stated in the pre solicitation conference that allocations will be made for travel, per diem and lodging for remote locations but this issue wasn’t addressed in the SOW. Whom determines when per diem will apply? What are the determining factors? Is there a pre determined location such as the JFO and any requests for service in excess of X miles away triggers the per diem and M&A?

If the contractor intends to pay its employees for lodging or per diem then it must account for those estimated costs in their proposed hourly rate.

No, DOL Wage Determinations set forth minimum rates, the Government cannot dictate what offeror's proposed to pay their employees.
