U.S. Department of Homeland Security Federal Emergency Management Agency Acquisition Management Division
Date: Tuesday, August 30, 2011
Justification for Other Than Full and Open Competition
Part I
1. Agency. Federal Emergency Management Agency (FEMA), Office of the Chief Information Officer, 500 C Street, SW, Washington, DC
2. Nature and/or description of the action being approved. This request is submitted for approval to limit this acquisition to AC Power Technology, Inc, a certified installer of Schneider Electric equipment.
3. Description of the supplies or services required to meet the agency’s need AC Power Technology (AC Power) is an authorized elite partner for APC by Schneider Electric. AC will be providing all labor, material, and supplies for the installation of new APC UPS equipment. The quote is for both APC equipment and the installation services. APC equipment has been approved to use by FEMA OCIO.
4. Estimated value of the acquisition. The estimated labor costs are $12,615.00 and the materials are $17,907
5. Authority for acquiring the supplies or services on other than a full and open competitive basis. (Applicable exception and justification to include a demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited below the selection.)
[x] Authority is FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements.
Justification:
This requirement is for the replacement of existing APC equipment to allow for the upgrade of the IT network at the Bothell MERS Facility located 228th Street, Bothell, WA. FEMA OCIO has done a review of the current network at the Bothell Facility and has determined that a new Uninterrupted Power Supply (UPS) is needed for the facility. FEMA OCIO has reviewed equipment that will be used on the FEMA IT network and has created a Technical Resource Manual (TRM) list that has preapproved equipment that agency programs may use in their IT operations.
APC equipment, P/N SYA16K16RMP is considered acceptable. The other items included in the request are approved by FEMA OCIO.
FEMA OCIO has decided to create a list of preapproved products that will allow for duplication and redundancy throughout the agent. This will allow FEMA IT Technicians to develop familiarity throughout the agency
6. Additional supporting facts for the acquisition:
The onsite IT technical POC identified the nearest APC/Schneider certified partner that could perform the work. A quote was obtained for the equipment and related installation services.
Based on Market research, it appears that no other APC certified installer is not located in a reasonable distance to the facility. To maintain warranty of the networks, the items to be installed must be done by a certified installer.
7. Actions taken to removal of barriers to competition.
The FEMA OCIO will continue to review alternatives sources as they become avaliable
I certify this requirement meets the Government’s minimum need and that the supporting data, which forms a basis for this justification, is complete and accurate.

2. Market Research.
3. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.
Based on the estimated acquisition value identified above, I concur with and approve the above justification:
