OFFICE OF ACQUISITION MANAGEMENT

Sole Source Justification (SSJ)

Simplified Procedures for Certain Commercial Items Exceeding the Simplified Acquisition Threshold (SAT)

FAR Subpart 13.5

J&A-19-0174

Pursuant to the requirements under the authority of simplified procedures for commercial items at 41 U.S.C. 1901 as implemented by Federal Acquisition Regulation (FAR) Subpart 13.501 and consistent with the content requirements of FAR 6.303-2.

1. Agency and Contracting Activity.

The Department of Homeland Security (DHS), U.S. Immigration and Customs Enforcement (ICE), Office of Acquisition Management (OAQ), proposes to enter into a contract on behalf of the Office of Asset and Facilities Management (OAFM) on a basis of other than full and open competition.

2. Nature and/or description of the action being approved.

(a) Type of action: Firm-Fixed-Price (FFP) Contract

(b) Amount the current J&A is justifying: $962,175.40

(c) Brief Description: OAQ intends to procure, on a sole source basis, 60 unreserved parking spaces in the Portals III underground parking garage using simplified acquisition procedures. This action is being taken pursuant to the authority of FAR 13.501. The vendor listed below is the only company that can provide the required services in the required location.

3. Description of Supplies/Services. Describe the supplies or services to be acquired.

Provide the estimated total value (including options, if any).

This requirement is to provide 60 unreserved secure parking spaces at Portals III for the ICE OAFM located at 1201 Maryland Ave, Washington, DC 20024. The proposed parking location is the ground/underground level garages under the building. The base year will be 12 months from date of award at an estimated cost of $183,050.85. The total estimated value of the contract is $962,175.40. This includes the amount for the Base Year with 4 Option Years.

4. Identification of the authority.

This action is being taken under the authority of Simplified Acquisition Procedures, 41 U.S.C.

1901, and consistent with the content requirements of FAR 6.303-2.

5. Demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited.

The Contractor is the legal agent of the building’s owner and it is therefore not legally possible for any other vendor to provide the parking spaces at this location. ICE’s requirement is based on its office location and mission specific to agency operations. The parking services at this location are necessary for the security of Government vehicles, and for providing confidentiality and security to witnesses, informants, and employees. The Government has determined that in accordance with FAR 6.302-1, the Contractor is the only source available that can meet the Government’s requirements.

6. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable.

ICE inquired with the General Services Administration (GSA) and with nearby commercial properties to assess capable and available sources, and obtain estimated pricing. In addition to these market research efforts, and in accordance with FAR 5.201, ICE will post a notice of the Government’s intent to sole source on the basis of FAR 6.302-1. Additionally, ICE will post this justification in accordance with FAR 13.501(a)(1)(iii) within 14 days after contract award.

7. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.

The current vendor, SP+ Corporation Parking’s monthly pricing for 60 unsecured parking spaces is $254.24, is determined fair and reasonable in accordance with FAR Part 13 based on comparable commercial pricing in the vicinity and historical prices.

8. Description of market research.

Market research was conducted in May 2019 by OAFM which found that SP+ Corporation Parking is the only vendor that can provide 60 indoor unreserved parking spaces under a single facility. The GSA Office of Portfolio Management and Real Estate (OPMRE), that manages space and parking garages, was contacted about other properties able to satisfy ICE’s requirement. The GSA OPMRE office that supports the National Capital Region, relayed that a query of the area revealed that no Federal parking spaces or properties can

9. Any other facts supporting the justification.

Not applicable.

10. A listing of the sources, if any that expressed, in writing, an interest in the acquisition.

Not applicable

11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for supplies or services required.

Due to the unique nature of this requirement, the Government intends to continue its market research efforts for other parking locations that may become available to obtain increased competition in the future.

12. DHS intends to post the requirement pursuant to FAR 13.501(a)(1)(iii) and 6.305(a).

13. Contracting Officer’s Certification.

I certify that the data supporting the recommended use of other than full and open competition is accurate and complete to the best of my knowledge and belief.
