(1) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6 as supplemented with additional information included in the notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued.

(2) The Department of Homeland Security (DHS), Customs and Border Protection (CBP), U.S.

Border Patrol, intends to award a Purchase Order (PO) for the procurement of Fiber Optic Splicer Kits assembled in accordance with the STATEMENT OF WORK (SOW). It is required that all offerors submitting a quote review the attached SOW to review all requirements. All offerors submitting a quote shall be required to meet the requirements found in the Solicitation and SOW.

(3) The solicitation number is 70B03C19Q00000243 and is issued as a Request for Quotes (RFQ). The solicitation documents and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2019-05. The associated North American Industrial Classification System (NAICS) code for this procurement is 335921 with a small business size standard of 1,000 employees.

(4) This procurement shall be set aside 100% for small business. All qualified, responsible sources may submit an offer that will be considered by the agency. Offerors are advised that they are responsible for obtaining any amendments that may be issued to the solicitation. The resulting contract shall be awarded to the offeror who provides the lowest price that is technically acceptable, with past performance evaluated for a determination of responsibility.

The place of performance shall be the offeror’s facility. The place of delivery shall be the three (3) locations specified in the SOW.

(5) Offerors shall complete and submit the SF 1449, and an attached quote, if desired, on or before the deadline of the RFQ, August 29, 2019 at 4:00 p.m. ET, via email only to colin.a.colgan@cbp.dhs.gov. Any questions about the requirement shall be submitted via email only to the same email address no later than August 28, 2019 at 4:00 p.m. ET. Government responses to questions may be published through FBO as an amendment to the solicitation so that all interested offerors will have access to the same information.

(6) Period of Performance: Delivery shall begin within thirty (30) days after date of award and final delivery of all products shall be within ninety (90) days after date of award, exclusive of any warranty periods required under the SOW.

(d) Comptroller General Examination of Record The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records--Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

II.10 PACKAGING, PACKING AND MARKING (MAR 2003)

Material shall be packaged, packed and marked for shipment in such a manner that will insure acceptance by common carriers and safe delivery at destination.

Packages shall be clearly identified on the outer wrapping with the contract number and delivery /task order number, if applicable.

II.11 CONTRACTING OFFICER'S AUTHORITY (MAR 2003)

The Contracting Officer is the only person authorized to approve changes in any of the requirements of this contract. In the event the Contractor effects any changes at the direction of any person other than the Contracting Officer, the changes will be considered to have been made without authority and no adjustment will be made in the contract price to cover any increase in costs incurred as a result thereof. The Contracting Officer shall be the only individual authorized to accept nonconforming work, waive any requirement of the contract, or to modify any term or condition of the contract.

The Contracting Officer is the only individual who can legally obligate Government funds. No cost chargeable to the proposed contract can be incurred before receipt of a fully executed contract or specific authorization from the Contracting Officer.

Beginning April 11, 2016, payment requests for all new awards must be submitted electronically through the U. S.

Technical capability is not as important as price. This requirement will be awarded to the offeror who provides the lowest price that is technically acceptable (LPTA), with past performance evaluated for determination of responsibility.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. (ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and

(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).

(b) The offeror shall email questions concerning sensitive technology to the Department of State at

CISADA106@state.gov.

(c) Except as provided in paragraph (d) of this provision or if a waiver has been granted in accordance with 25.703-4, by submission of its offer, the offeror--

1 BACKGROUND

Customs and Border Protection (CBP) is seeking quotations in an effort to purchase fiber optic splice kit. Due to mission operations, it is critical to procure a fiber optic splice kits needed to splice new fiber optic line and equipment into existing fiber optic networks. This effort seeks to use a Firm, Fixed Price Type Contract. Detailed specifications for the consumable items and accessories are provided in Section 5.

2 SCOPE

This document describes the products and execution requirements relating to the purchase of fiber optic splice kits needed for splicing new fiber optic line and equipment into existing fiber optic networks. Fiber Optic splice kit includes all needed components, attachments, software, hardware, cables and cables needed to splice and test new fiber optic lines or equipment into existing fiber optic networks.

a. The work included under this specification consists of furnishing tools and supplies at a Firm Fixed Price (FFP) that is identical or equal to equipment outlined in Section

5; and

b. All parts, sections, and items of this Statement of Work (SOW) must be addressed by the vendor. Any exception to any Part, Section, or Item, taken by the vendor, must be clearly identified and documentation provided indicating the compatibility, suitability and durability of the products.

5.4 Documents

As referenced in Section 4.2, the vendor shall provide copies of the documents listed below if requested by CBP. For each applicable item, one copy of the data shall be delivered in paper form and one copy in electronic form. The electronic form shall be in Microsoft

Word format or Adobe Acrobat. The documents are deliverables under the contract and shall be provided in a timely manner if requested:

6 GOVERNMENT FURNISHED EQUIPMENT AND INFORMATION

The Government does not anticipate providing any Government-furnished equipment or

Government-furnished information.

7 PLACE OF PERFORMANCE

The point of delivery shall be the locations specified in Section 5.3 in this SOW.

8 PERIOD OF PERFORMANCE

The equipment delivery shall begin within 30 days after order is awarded, and final delivery of all products described in this SOW must be within 90 days of the award.

9 SPECIAL CONSIDERATIONS

9.1 Changes to the SOW

No changes to this SOW or cost shall be incurred without prior approval of the Contracting

Officer (CO). The CO is the only individual with the authority to amend this contract. Any changes or cost increases will not take effect until the CO executes a written modification.

Only the CO has the authority to represent the Government in cases where the task order requires a change in the terms and conditions, delivery schedule, scope of work and/or price of the products and/or services under this task order.

9.2 Travel

Travel is not required to support the tasks identified in the SOW.

9.4 Invoice Instructions

The vendor shall submit one invoice for the final cost. A copy of the invoice shall be submitted through the Invoice Process Platform (IPP) with notifications to the

Technical POC.

The invoice should include the following:

- Order number;

- Description of services provided for a specified time period;

- Unit price and total amount of each item;

- Discount terms;

- Company name, telephone number, taxpayer’s identification number; and

- Complete mailing address to which payment will be mailed.
