U.S. Customs and Border Protection Justification and Approval For Other Than Full and Open Competition
For contracts or orders above the Simplified Acquisition Threshold (SAT)
Version 3.0 November 2020 extension of the existing contract performance period with North Wind Resources LLC is critical to provide continuity of operation of the existing FITT system, and transition support services until the new CBP PPM system is fully operational.
While other vendors are active in the program and project management systems arena, transitioning to any other vendor for this short-term period of performance would cause unacceptable delays due to the need for them obtaining BI/Clearances and building the requisite knowledge and experience to perform the work. As a result, no other vendors would be able to provide the immediate expertise to assist CBP in transitioning from FITT to the new PPM system without causing undue delay and disruption to CBP mission-critical operations.
Furthermore, since the FITT system is being phased out, if there were any potential immediate savings (which is unforeseen at this time) would not be recovered through competition.
6. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable.
A SAM.gov notice will be publicized as required by FAR Subpart 5.102(a)(6) and 5.2.
7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable.
The Contracting Officer determines that the anticipated price will be fair and reasonable based on a detailed price analysis of the Contractor’s proposal. The Contracting Officer will compare the Contractor’s proposed price to the IGCE and prior contracts for the FITT system to determine whether proposed prices are fair and reasonable.
8. Description of Market Research.
Market Research included acquisition history review, internet searches for contractors that could provide the system support, and interviews with knowledgeable individuals in the industry and Government. The market research showed that only North Wind Resources LLC could provide the ongoing system services and system transition requirements without significant mission and/or financial impact to CBP. Any other company would require require an unacceptable period of delay to needed CBP background checks and time to obtain the requisite knowledge to successfully perform the requirements of the contract.
9. Any Other Facts Supporting the Use of Other Than Full and Open Competition.
CBP utilizes the FITT system for program and project management of critical Border Infrastructure projects necessary to support the U.S. Border Patrol’s operational mission to secure the U.S. Border. Maintaining the existing FITT system and providing transition support to the new PPM system without impact to the mission or increased costs is of critical importance to ensuring security of the U.S. Border.
10. A Listing of the Sources, if Any That Expressed, in Writing, an Interest in the
Acquisition.
No other sources have expressed interest in this acquisition.
