STATEMENT OF WORK
Maritime Administration
Import and Export data
A. Scope
The Maritime Administration, Office of Policy and Plans (OPP) is soliciting quotes to purchase an existing database that tracks and stores information from commercial bills of lading for waterborne imports and exports in the United States.
B. Objective
OPP requires a subscription to US waterborne inbound and outbound transportation and trade data covering 100-percent of US port locations for its daily operations requirements. Specifically, OPP is looking for U.S. inbound and out waterborne shipments, including imports and exports in all trade lanes, all commodities, all states/U.S. regions, all consignees/shippers, and all countries of origin or destination, for Twenty Foot Equivalent Units (TEU) and shipping weight in an existing online database. The database must include historical records of U.S. inbound and outbound information dating back at least 10 years starting at the commencement of the contract. OPP performs extensive time series and other analyses on international transportation and trade data through matching and merging with other data sets, and accordingly requires the capability of downloading all available historic and current data from the database to be stored locally on OPP servers. A list of required data fields are provided below. OPP requires access to the data in its least aggregate format (e.g. not aggregated beyond the list of fields below) so that they can perform customized analysis in conjunction with other data sets.
Specific data fields needed:
• Bill of lading number
• Vessel name, IMO code, voyage number
• Ocean carrier/shipping line
• NVOCC
• Consignee name/address
• Shipper name/address
• Notify name/address
• Non-U.S. location and country of lading/unlading
• Loading/Unloading date at U.S. port
• Arrival/Departure date (for vessels at US exports)
• Location and country of origin/destination
• Port of discharge/transshipment port
• Full description of goods
• Weight
• Number of containers and their corresponding size and/or number of TEU’s
• Six-digit HS code
• Master and house bill of lading numbers
• Estimated value
• Vessel flag/country of registry
• Containerized/non-containerized indicator
• Refrigerated, potentially hazardous, roll-on/roll-off cargo
• Ability to export data into Microsoft Excel
• Ability to export data into an XML format
• Ability to perform download of entire data set or receive a dump of entire data set within 24 hours of request
C. Government Requirements
Place of Performance. The delivery of services under this Statement of Work will be implemented through an online database. It is important to note that OPP is not requesting the development of a customized interface or database. The requirement is for a “ready to go” product with an existing interface and the capability of downloading (or receiving a download of) the data set behind the database in its entirety as necessary. The online database must be fully functional and available to OPP staff 30 days after award of the contract. Extensions will not be granted
Period of Performance. The period of performance will be one base contract year plus four additional option years. The option years may be exercised by the Federal government annually. All quotes should include pricing for the base year and each of the four additional option years
Hours of Performance. The Period of Performance will cover three hundred sixty five days per year, seven days per week, and twenty-four hours per day.
Coordination with Government Staff. The contractor will coordinate closely with the Office of Acquisitions and Office of Policy and Plans as the contract progresses, as needed.
D. Contractor Requirements
Staff Support. The contractor will provide support and cooperation to government staff offices for the availability, delivery, quality, accuracy, and completeness of the product.
E. The website shall comply with Section 508 requirements.
F. Deliverables
Online Access. The contractor should ensure reliable online access to the objective above is made available.
G. Evaluation Criteria
Technical approach is more important than past performance. When combined technical approach and past performance are more important than price.
The evaluation criteria below define the optimum performance by the vendor, and would provide significant value to the analysts in MARAD. While MARAD fully intends to obtain the least cost solution for its business requirements, analyses of potential suppliers will be based on best value, and accordingly the criteria mentioned below carry more weight than cost alone.
MARAD will weigh the factors (a) through (g) below in conjunction with project cost to determine the best value. There may be instances where lack of capability to sufficiently provide criteria below to a certain standard will disqualify a particular vendor from consideration regardless of cost. For example, any lack of coverage under sub-subsection (a) would result in disqualification.
Technical Approach
a. Data coverage: The vendor shall provide complete coverage of both U.S. inbound and outbound cargo and vessel movement information for the required fields listed under section (B). U.S. Inbound and outbound cargo and vessel moves should include imports and exports, as well as shipments that transit through U.S. territory without entering U.S. commerce. For these in-transit shipments, only shipments that enter or leave the U.S. by the vessel mode of transportation are required, although all in-transit shipments would be preferred.
b . Time series:
c. Historical data should be readily accessible for the latest available year and include at least the prior 10 years of historical data. Readily available means that all data is stored locally with or can be retrieved from the vendor instantly upon the client’s demand with no volume or frequency limitations. There should be no gaps in the time series information. The format and content should be consistent across the time series.
c. Latency of data: Data for the specified fields should be made available to the client no later than 30 days after the shipment activity occurs, commencing at the start of the contract (e.g. the client would expect to be able to run a monthly report using complete January 2017 data on March 1, 2017.
d. Standard reporting of data by vendor: Data should be made available in a consistent format through a standard process (e.g. an online portal to query for an entire bulk download of data, or for select records based on set criteria). The data made available should be consistent across the time series in which the data are available.
e. Standard Data Classification: The data should be coded with standard codes where applicable. Commodities should be classified and coded based on the Harmonized system to the 6 digit level. Domestic ports for inbound and outbound cargo should be coded based on the Customs/Census Schedule D codes. Foreign (non-U.S.) ports should be classified based on the Army Corps Schedule K codes. The IMO number for each vessel is desirable for those vessels that have them. All fields containing codes should have appropriate decodes for every observation reported, preferably in a column adjacent to the code, but it is also acceptable that the code and its appropriate decode could be made available in a separate table.
f. Data source: The data should be from authoritative and credible sources. Examples of such sources are CBP cargo entrance and manifest data, Census shippers export declaration data or export manifest data, CBP vessel entrance and clearance data, or ocean manifests and bills of lading. The contractor shall be responsible for acquiring and providing all data under the scope of this solicitation to the MARAD Office of Policy and Plans
g. Data quality: Fields required under section (B) should be populated with accurate data unless the reporting of such information is expressly established to be conditional or optional. As specified in sub-section (e) under Section (B), all codes in the data should have an appropriate and meaningful definition.
h. Availability: The Online database and capability to download all data should be made available to OPP starting no later than 30 days after award of the contract.

52.212-2 Evaluation—Commercial Items.
As prescribed in 12.301(c), the Contracting Officer may insert a provision substantially as follows:
Evaluation—Commercial Items (Oct 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
Technical Approach, Past Performance and Price (See statement of work, Attachment A, for all evaluation criteria.) _______________________________________________ Technical Approach is more important than Past Performance. When combined technical approach and past performance are more important than price.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(i) Taxes are considered delinquent if both of the following criteria apply:
(A) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.
(B) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.
(ii) Examples.
(A) The taxpayer has received a statutory notice of deficiency, under I.R.C. §6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(C) The taxpayer has entered into an installment agreement pursuant to I.R.C. §6159.
The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.
(D) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. §362 (the Bankruptcy Code).
