This is a notice that the US Environmental Protection Agency (EPA) Office of Acquisition Management (OAM), located at 1200 Pennsylvania Avenue NW Washington, DC 20460, will issue a solicitation for support of the Mobile Source Enforcement Branch (MSEB) within the Air Enforcement Division (AED), located in the Office of Civil Enforcement. The majority of the work under this requirement is expected to involve field inspections, investigations, and audits to support Clean Air Act (CAA) mobile source regulatory and enforcement activities. The full scope is detailed in the draft statement of work (SOW) which is provided as part of this notice.
The applicable North American Industry Classification System (NAICS) code is 541620. Current support for this effort is provided under contract EP-W-12-007, with Eastern Research Group (ERG), which is scheduled to expire on October 5, 2018.
EPA plans to issue a request for proposal (RFP), and subsequent award, as soon as practicable. A five-year, time and materials, single award contract using full and open competition under Federal Acquisition Regulation (FAR) Part 15, “Contracting by Negotiation Procedures,” is anticipated. Award will be made to the offeror that is evaluated to provide the best value to the agency. The estimated level of effort for the requirement, including all options and optional quantities, is 117,500 hours. The contract will not involve on-site performance; however, travel for inspection, investigation, and audit activities is expected to be required. Because of the nature of the requirement, the number and frequency of such trips cannot be predicted in advance with any certainty.
The resultant contract will contain a Limitation of Future Contracting clause stipulating that during the life of the contract, unless prior written approval is obtained from the cognizant Contracting Officer, the Contractor shall not enter into any type of agreement with 1) owners or operators of facilities which may be regulated parties under the Clean Air Act (CAA) or 2) private entities that have a financial interest in or a business relationship with any such regulated parties. As part of its response, the offeror shall certify as to whether it has any potential organizational conflicts of interest (OCI), and provide a satisfactory Conflict of Interest Plan.
