Acquisition Plan Action ID: VA-19-00033075

1. Contracting Activity: Department of Veterans Affairs, VISN 23, Central Iowa Health Care System Medical Center 2237 – 636-19-2-9284-0038

2. Nature and/or Description of the Action Being Processed: Emergency replacement of medical center water softener system. Award type – Firm Fixed Price, Not to Exceed $200,000.

3. Description of Supplies/Services Required to Meet the Agency’s Needs: Materials, equipment and labor necessary to replace two water softeners. These softeners are the only source of soft water for the Des Moines VAMC. This contract will remove and replace the existing water softeners which are have begun leaking with no replacement parts available due to obsolescence.

4. Statutory Authority Permitting Other than Full and Open Competition:

FAR 6.302-2 – The water softeners have recently developed leaks that cannot be patched or repaired. Replacement parts are not available and the system has exceeded its useful life.

The water softener system is vital to the operation of the medical center. Without soft water, medical processes such as equipment sterilization, dialysis and laboratory testing cannot be carried out. Hard water will quickly deposit scale into recently activated boilers and all components of the steam heating system leading to voided warranties and plugged lines.

Covenant Construction Services (CCS) is already mobilized in the building where the water softeners are located for a competitively awarded NRM Construction Project. They are the only responsible vendor who can respond quickly enough to replace the softeners before they fail completely.

FAR 6.302-5 – Public law 109-461 allows the VA to sole source construction projects to SDVOSB contractors. CCS meets this criteria.

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

a. Unusual and Compelling Urgency: The Medical Center’s sole water softener system has developed active leaks in the controller body. The manufacturer no longer supports this controller due to its age and parts are no longer available. This water softener system supplies all soft water for the boiler plant, chiller systems, potable water and dialysis services. Failure of the water softeners will cause disruption to steam generation and potable water supply to the medical center.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:

a. FAR 6.302-2 – The water softeners have recently developed leaks that cannot be patched or repaired. Replacement parts are not available, and the system has exceeded its useful life. The water softener system is vital to the operation of the medical center. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: IGCE was developed using prior similar requirements – Previous reference project include project 636A6-11-909, Expand Remodel Pharmacy and 636A6-12-203 – Centralized Boiler Chiller Plant. Also sought out a market research quote from the manufacturer for the water softener system, IGCE submitted.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: A market research quote from the manufacturer for a current model system has been sourced.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition:

A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: As a Non-Reoccurring Maintenance contract, this item will not require a follow-on project or subsequent acquisitions.
