FOR OTHER THAN FULL AND OPEN COMPETITION

I. CONTRACTING ACTIVITY

II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED

A. This justification and approval is for the 30th Space Wing (SW) to award a sole source contract to InDyne, Inc., for work that is currently being performed for the 614 Air and Space Communications Squadron (ACOMS) on Task Order Directives (TODs) issued against the basic terms and conditions of Contract F04684-03-C-0050, Western Range Operations, Communications and Information (WROCI) Contract. The TODS expire on 24 Sep 15 and the new contract will be effective 25 Sep 15. There is a 30 CONS acquisition (FA4610-15-R-0007) underway to award a 5 year task order under the NETCENTS II (NetOps & Infrastructure Contract (SB)) contract.

However, award is not projected until 20 Jul 16. Until that contract is awarded, a sole source interim contract will be awarded to InDyne to prevent a gap in service. We propose to award a contract with a 5-month base period, 25 Sep 15 –29 Feb 16, and, 6 one-month options, 01 Mar 16

– 31 Mar 16, 01 Apr 16 – 30 Apr 16, 01 May 16 – 31 May 16, 01 Jun 16 – 30 Jun 16, 01 Jul 16 – 31 Jul 16, and 01 Aug 16 – 31 Aug 16, for approximately 12 months. This interim contract will allow time to procure the follow-on effort. If award is made sooner than projected, all options will not be utilized.

B. Background: The TODs (Cost Plus Fixed Fee) were awarded against the WROCI contract prior to the expiration of the contract on 05 Apr 2015. The TODs provide critical support to 614 ACOMS mission at Vandenberg. The requirements supported by these TODs fall within the scope of the NETCENT-2 Network Operations and Infrastructure (NetOps)(SB) contract. NetOps (SB) was awarded on 02 Apr 15 with the ordering period opening in May 2015. This contract is the mandatory source for in-scope work. The NETCENTS-2 NetOps (SB) contract was originally intended to be available by Sep 2012, but was then pushed back to Mar 2013 and was not made available for ordering until Apr 2015 because of numerous GAO protests that are now resolved.

Due to the lead time needed to procure these services competitively, the interim contract will be awarded to the incumbent, InDyne.

III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE AGENCY NEEDS

A. The Request for Proposal and accompanying Performance Work Statement (PWS) will describe the work as follows: This contract shall support the 614 Air and Space Communications Squadron (614 ACOMS) in supplying 24/7/365 Information Technology (IT) services for the Joint Space Operations Center (JSpOC). Additionally, the contract shall support 614 ACOMS IT services for Fourteenth Air Force (14 AF) and Joint Functional Component Command for Space (JFCC SPACE) customers at Vandenberg AFB. The 614 ACOMS is a direct reporting unit to the Commander, 14 AF / Commander JFCC SPACE.

The scope of this contract is to operate and maintain the IT infrastructure, consisting of multiple networks, numerous C4I systems, and client devices, required for continuous 24/7/365 JSpOC operations.

Additionally this contract covers requirements necessary to provide IT services supporting the JSpOC 14 AF and JFCC SPACE customers residing in multiple locations on Vandenberg AFB.

B. The government intends to negotiate a Cost Plus-Fixed Fee (CPFF) Contract. This contract will also include CLINs with Cost Reimbursement CLINS (non-fee bearing) for Materials, Travel and Overtime. The estimated cost of these services for approximately 12 months is

C. InDyne is classified as a large business under NAICS 517110. The government intends to require subcontracting under this contract. The government will impose a minimum of 3% subcontracting.

IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION

The statutory authority for this action is contracting by Other than Full and Open Competition, 10 U.S.C. 2304(c)(l), as implemented by FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements.

and/or redacted contract for this effort. We answered, yes, at time of award. Atlantic CommTech Corporation is a NETCENTS 2 SB NetOps contractor who responded, stating that they are one of 17 companies competing for contracts via NETCENTS 2 SB NetOps and he was concerned with our performance periods. The synopsis reflected a 6-month base and two 3-month options for a total of 12 months. We have since changed to a 5-month base, and 6, 1-month options. This allows us to have a vehicle that can be used if any delays occur; yet that vehicle will be designed with the flexibility to terminate the interim contract if award of the 614th ACOMS NETCENTS 2 NetOps SB task order occurs earlier than projected.

VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE

GOVERNMENT WILL BE FAIR AND REASONABLE

The Contracting Officer anticipates the costs for this effort will be fair and reasonable. In accordance with FAR 15.403-4, the contractor will be required to provide certified cost and pricing data. The Contracting Officer will make a determination as to the cost fairness and reasonableness based on, but not limited to, the following recommendations: Program Office technical evaluations and extensive cost for prior service contract history and the Independent Government Estimate

(IGE).

VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS OR A STATEMENT OF

THE REASONS MARKET RESEARCH WAS NOT CONDUCTED

Market research revealed that there are over 17 companies vying for the 614 ACOMS contract to be awarded via NETCENTS 2 SB NetOps. However, there are no companies interested in this bridge contract with a 5-month base, and 6, 1-month options.

IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION

The proposed interim contract would ensure continuation of mission essential services. InDyne, Inc. the incumbent, holds all required certifications and clearances, is familiar with the complexity of the facility and the equipment, and is fully capable of continuing to perform for the approximately 12-month interim contract.

X. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE ACQUISITION

There were no interested offerors who expressed interest in proposing on the bridge contract.

XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME

ANY BARRIERS TO THE COMPETITION BEFORE MAKING SUBSEQUENT ACQUISITIONS FOR THE

SUPPLIES OR SERVICES REQUIRED

As described in Section II, a competition for the Solicitation No. FA4610-15-R-0007, for 614 ACOMS IT support requirements here at Vandenberg AFB, is currently on-going, with an anticipated award date of 27 Jul 16. We plan to have a 5-month base period, 25 Sep 15 –29 Feb 16, and up to 6 1-month options, 01 Mar 16 – 31 Mar 16; 01 Apr 16 – 30 Apr 16; 01 May 16 – 31 May 16; 01 Jun 16 – 30 Jun 16; 01 Jul 16 – 31 Jul 16; and 01 Aug 16 – 31 Aug 16, for a total of approximately 12 months. Only the option periods needed until the competitive action is complete will be utilized.

XII. CONTRACTING OFFICER’S CERTIFICATION

As evidenced by my signature above, I have determined this document to be accurate and complete to the best of my knowledge and belief.
