About this file

This document is a 2021 Sole Source Request and Determination Form from the Cobre Consolidated School District in New Mexico, seeking to contract with Sunbelt Staffing, LLC for special education teaching services. The contract is for a ten-month term with a total value of $83,160.00 before tax, aimed at filling a critical special education teacher vacancy. The contracted services include comprehensive responsibilities such as creating and implementing Individual Education Programs (IEPs), providing remote and on-campus instruction, developing lesson plans, evaluating student performance, and maintaining professional standards for students with disabilities.

The sole source justification stems from the district's inability to hire a full-time special education teacher and the contractor's unique capability to provide in-person services, which is preferable to remote-only alternatives. The district conducted due diligence by contacting LSG/ACES Education Services and determining that Sunbelt Staffing, LLC is the only viable provider capable of meeting their specific needs. The contractor is a licensed Special Education Teacher in New Mexico who can work directly on campus, which the district considers highly desirable for effectively supporting students with disabilities and meeting their individualized educational requirements.

s. Safeguard the confidentiality of information pursuant to the Family Educational Rights and Privacy Act (FERPA) and other applicable state and federal statutes.

t. Perform such other tasks as may be assigned.

IV. Provide a detailed explanation of the criteria developed and specified by the agency as necessary to perform and/or fulfill the contract and upon which the state agency reviewed available sources. (Do not use “technical jargon;” use plain English. Do not tailor the criteria simply to exclude other contractors if it is not rationally related to the purpose of the contract.

Using the Cobre Consolidated job description and job duties as assigned to district employees performing the same duties as special education teacher, the district uses contracting agencies to locate qualified candidates to work at Cobre Consolidated Schools either remotely or in person. This contractor is available to work with students directly on campus, which is highly desirable compared to a virtual/remote candidate.

V. Provide a detailed, sufficient explanation of the reasons, qualifications, proprietary rights or unique capabilities of the prospective contractor that makes the prospective contractor the one source capable of providing the required professional service, service, construction or item(s) of tangible personal property. (Please do not state the source is the “best” source or the “least costly” source. Those factors do not justify a “sole source.”)

The contractor is a licensed Special Education Teacher in the state of New Mexico and will provide required special education services to students with disabilities on campus (in person). This is desirable because many other contractors are only available remotely.

A. Provide a detailed, sufficient explanation of how the professional service, service, construction or item(s) of tangible personal property is/are unique and how this uniqueness is substantially related to the intended purpose of the contract.

The contractor will provide legally-required special education services to students attending Cobre Consolidated Schools.

B. Explain why other similar professional services, services, construction or item(s) of tangible personal property cannot meet the intended purpose of the contract.

Cobre Consolidated Schools has not been able to locate a district hire Special Education teacher to fulfill this vacancy, which would be the most desired situation. While virtual contractors are another viable option, in person services are preferred for students with disabilities due to having greater access to direct instruction and other support needed to address their needs as indicated in their Individualized Education Plan (IEP)

C. Provide a narrative description of the agency’s due diligence in determining the basis for the procurement, including procedures used by the agency to conduct a review of available sources such as researching trade publications, industry newsletters and the internet;

contacting similar service providers; and reviewing the State Purchasing Divisions’ Statewide Price Agreements. Include a list of businesses contacted (do not state that no other businesses were contacted), date of contact, method of contact (telephone, mail, e-mail, other), and documentation demonstrating an explanation of why those businesses could not or would not, under any circumstances, perform the contract; or an explanation of why the agency has determined that no businesses other than the prospective contractor can perform the contract.

The position for in-person(s) Special Education teachers has been vacant for two (2) plus years and the district has been unsuccessful in filling this position. LSG, who has a contract with ACES Education Services, was contacted. LSG does not have in-person providers in our region.
