About this file
This justification and approval document describes a sole source award of a contract by the Naval Sea Systems Command to procure a mobile antenna system from Telemetry and Communications Systems Inc. The Naval Surface Warfare Center Corona Division requires a telemetry system capable of supporting missile testing at various ranges by December 2022. The contract will procure one Model 2400M-8 L/S Band Mobile Tracking Antenna System and one spare C-Band feed from TCS for a total estimated value of $339,400 to be funded by FY22 RDT&E funds. A sources sought notice solicited interested parties in October 2021 but only one response was received and deemed unable to meet requirements. The justification cites that only TCS can meet the form, fit and function requirements for the specialized equipment, including limited space constraints for shipboard use. The contracting officer determined the anticipated costs from TCS to be fair and reasonable, and the contract was awarded to TCS on February 22, 2022 for $350,600.

JUSTIFICATION AND APPROVAL
IN REPLY REFER TO
J&A No. 50,278 Ser 02/3805
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity
The Naval Sea Systems Command (NAVSEA), Naval Surface Warfare Center, Corona Division (Corona Division), Contracts Department, Code 0221.
2. Description of the Action Being Approved
Award of a Firm Fixed Price (FPP) supply contract on a Sole Source basis for the procurement of one (1) Model 2400M-8 Mobile Antenna System from Telemetry and Communications Systems Inc.
(TCS). The system for the support of the ADVANCED TELEMETRY SYSTEM in support of NSPO SEATASK 1066/2272.
3. Description of Supplies/Services
The NSWC Telemetry Systems Branch (PA44) facility at Corona has a requirement to provide a telemetry system capable of supporting missile testing for multiple projects at various missile test ranges as well as broad open-ocean testing beginning December 2022. The table below identifies the specific Manufacture part number required for this Sole Source requirement:
Manufacturer Part Number Quantity Description Telemetry &
Communications Systems, Inc.
(TCS
Model 2400M-8 1 L/S Band Mobile Tracking Antenna System
Telemetry & Communications Systems, Inc.
(TCS)
Spare C-Band Feed 1 Spare C-Band Feed with Down Converter (4400- 5250 MHz), Prime Focus
Controlled Unclassified Information Source Selection Information—See FAR 2.101 and 3.104
Ser 02/3805
The total estimated value of this acquisition is $339,400.00 and will be funded with Fiscal Year 2022 (FY22) Research, Development, Test, and Evaluation (RDT&E) funds.
Appropriation FY22 Total
RDT&E $339,400.00 $339,400.00
The Government’s minimum needs have been verified by the certifying technical and requirements personnel.
4. Statutory Authority Permitting Other Than Full and Open Competition
10 U.S.C. 2304(c)(1) Only one responsible source and no other supplies or services will satisfy agency requirement. The statutory authority permitting this sole source action is 41 U.S.C. 1901, Simplified acquisition procedures - a sole source acquisition using simplified acquisition procedures for the acquisition of commercial items, as implemented by FAR 13.501(a).
5. Rationale Justifying Use of Cited Statutory Authority
The statutory authority permitting other than full and open competition applies to this procurement because the Mobile Antenna System Model 2400M-8 is the only component of its kind available in the market which would meet all of PA44 shipboard ATS requirements for reasons below:
a. In accordance and to comply with the Government’s prerequisite, the Mobile Antenna System Model 2400M-8 shall possess the required configuration that meet all requirements of form, fit and function as a highly specialized equipment and major component of the ATS. The form and function requirements are particularly critical for shipboard telemetry systems. They have to fit in tight spaces, carried through hatches and doors when deployed on a ship. The limited space that we have been allocated to install this equipment is a hard requirement that cannot be adjusted. This is the only antenna of its type that elizabeth.groncki Highlight elizabeth.groncki Highlight elizabeth.groncki Highlight
Ser 02/3805 meets this limited space requirement. One of the salient features of this antenna is its lightweight and modular concept but is still capable of carrying up to 8-foot antenna. The 2400M antenna pedestal is broken down into modular pieces for ease during transport and assembly of the antenna without the need of lifting equipment. The Mobile Antenna System Model 2400M-8 is a proprietary component manufactured solely by TCS.
b. The ACU-M1L (the Red Hat Enterprise Linux version of the
ACU-M1 operating system) can be configured to support up to 8 Automatic Gain Control (AGC) and 8 Amplitude Modulation (AM) connections (no longer required for auto-tracking by using AGC Tracking) from tracking receivers. With the last generation of Antenna Control Unit (ACU) interface Printed Circuit Board (PCB), the 8 AM ports are provided but not required. Actually, AM signals for auto tracking are no longer required through these ports but instead they are being derived from the AGC ports. This new tracking technology results in the improvement of the overall tracking loop by releasing the 100 mass spectrometric (ms) AGC time constant constraint. Using AGC only for auto tracking, the receiver AGC time constant can now be set to the fastest speed available, typical .1 ms.
The associated cost to the government of identifying a potential alternate product, field testing, re-training staff, and transitioning all products to the new system is extremely large.
A Request for Information (RFI) would be required, two (2) months of additional time and approximately 120 hours to prepare, publish, and evaluate responses. To test the product, each mission will have a minimum of 100 engineers supporting (labor per event estimated at $1,000,000). In addition, the cost of operating the ship: fuel, shipboard crew (minimum 25), wear & tear, etc. will be in excess of $800,000 per event. There is an associated cost with reserving the range for use, estimated at a minimum of $200,000 per event. That is estimated a minimum of $2 million per event in labor, ship and range costs alone, with multiple events planned soon after the required delivery date.
Although very large, that $2M cost pales in comparison to the cost of incurring delays to the overall program and possibly elizabeth.groncki Highlight elizabeth.groncki Highlight elizabeth.groncki Highlight elizabeth.groncki Highlight elizabeth.groncki Highlight elizabeth.groncki Highlight elizabeth.groncki Highlight
Ser 02/3805 even missing acquisition Milestone gates. That cost would be measured in hundreds of millions. Weapons tested onboard are slated for deployment onboard AEGIS Destroyers, each of which costs over $1 billion dollars to build and field for the US Navy.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
A Sources Sought notice was posted on Beta System for Award Management’s (SAM) website on 15 October 2021 with a closing date of 28 October 2021 to express the Government’s intent to purchase of the mobile antenna equipment and to request interested parties submit a capabilities statement indicating if they can provide the supplies listed in the statement of work.
One (1) business responded and provided a capability statement.
The capability statement was sent to PA for technical evaluation. The customer concluded that the respondent would be unable to satisfy requirements because the respondent’s capability statement, which reflected past performance only, did not demonstrate the capability to meet the minimal requirements. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than TCS to provide the required supplies.
7. Determination of Fair and Reasonable Costs
The Contracting Officer has determined that the anticipated cost to the Government for the supplies covered by the J&A will be fair and reasonable.
8. Actions to Remove Barriers to Competition
For the reasons set forth in Section 5, Corona Division, Contracts Department has no plans at this time to compete future contracts for the types of supplies covered by this J&A. If another potential source emerges, Corona Division will assess whether competition for future requirements is feasible.
