About this file

This justification and approval document outlines a planned sole source award by the Naval Surface Warfare Center Corona Division to Keysight Technologies for a secondary noise source system. The Naval Air Systems Command Metrology and Calibration Program requires specific Keysight Technologies equipment totaling $265,189.91 to replace aging calibration standards used by the Navy Primary Servicing Laboratory. This highly specialized equipment from the original equipment manufacturer is the only option that can maintain the necessary accuracy and compatibility with the existing LabVIEW software for calibrating noise figure analyzers across the Navy inventory. The subsequent award notice confirms that contract N6426722P0129 was issued to Keysight Technologies on August 12, 2022 for $280,702.95 by the Department of the Navy Naval Sea Systems Command to fulfill this sole source requirement.

Appropriation FY22 Total

APN $265,189.91 $265,189.91

The Government’s minimum needs have been verified by the certifying technical and requirements personnel.

4. Statutory Authority Permitting Other Than Full and Open Competition.

10 U.S.C. 2304(c)(1), only one responsible source and no other supplies or services will satisfy agency requirement. The statutory authority permitting this sole source action is 41

U.S.C. 1901, Simplified acquisition procedures - a sole source acquisition using simplified acquisition procedures for the acquisition of commercial items, as implemented by FAR 13.501(a).

5. Rationale Justifying Use of Cited Statutory Authority.

As discussed below, the nature of the acquisition requires the use of the above cited authority. NAVAIR METCAL currently utilizes the Secondary Noise Source System from Keysight Technologies. Due to the equipment being highly specialized, the parts from the Original Equipment Manufacturer (OEM), Keysight Technologies, are the only ones that can withstand the stress of calibrating support equipment while maintaining accuracy and precision. These calibration standards would be used by the Navy Primary Servicing Laboratory to calibrate the Noise Figure Analyzer workload found in the Navy’s inventory. This procurement is required to replace calibration standards that have lost functionality due to broken parts or ageing internal components. If any other brand besides Keysight Technologies was procured it would not be compatible with the current LabVIEW software setup and the programming would need to be completely rewritten. Rewriting the program would involve completely new installation, system verification, check standard SPC’s, NIST submission, training, and Primary Measurement System Documents (PMSD) which would take no less than 640 hours or 80 days and costing no less than $127,000, combining cost & hours/days for new installation, system verification, check standard, NIST submission, training and

PMSD.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

A Sources Sought Notice (SSN) was posted on Beta System for Award Management’s (SAM) indicating the Government’s intent to sole source this requirement to Keysight Technologies. The posting was issued on 17 March 2022 and closed on 21 March 2022. There were no interested vendors. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than Keysight Technologies to provide the required supplies.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined that the anticipated costs to the Government for the items covered by this J&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in Section 5, Corona Division, Contracts Department has no plans at this time to compete future contracts for the types of supplies covered by this J&A. If another potential source emerges, Corona Division will assess whether competition for future requirements is feasible.
