About this file

This document is a justification for other than full and open competition submitted by the United States Coast Guard Aviation Logistics Center Information Systems Division. The agency requires a one-year maintenance and support subscription for IBM Accelerated Value Program software from September 1, 2023 through August 31, 2024. This sole source purchase is justified as IBM is the owner of all proprietary rights and data related to the software design, which is required to service the hardware and make any changes to the code. The government does not own or possess any rights to the software source code, preventing an adequate technical purchase description from being developed to solicit competition. As the necessary data is proprietary to IBM, it is difficult for the government to take steps to foster future competition for modifications to this software.

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

SIMPLIFIED ACQUISITION PROCEDURES (SAP) FAR 13.106-1(b)

THIS DETERMINATION MUST BE SUPPORTED WITH FULL JUSTIFICATION FOR SOLE SOURCE FROM THE CUSTOMER. WHEN THE CUSTOMER DESCRIBES AN ITEM WITH A PURCHASE DESCRIPTION WHICH LIMITS THE AVAILABILITY TO ONE SOURCE, THE JUSTIFICATION MUST EXPLAIN WHY THE ITEM IS THE ONLY ONE THAT WILL MEET THE GOVERNMENT’S REQUIREMENT. STATEMENTS SUCH AS "ONLY KNOWN SOURCE" OR "ONLY SOURCE WHICH CAN MEET THE REQUIRED DELIVERY DATE" ARE INADEQUATE TO

SUPPORT A SOLE SOURCE PURCHASE.

IDENTIFICATION OF THE AGENCY AND THE CONTRACTING OFFICE, AND SPECIFIC IDENTIFICATION OF THE DOCUMENT AS A “JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION.” PLEASE CITE THE

AUTHORITY AND TYPE OF JUSTIFICATION.

The United States Coast Guard (USCG), Aviation Logistics Center (ALC), Information Systems Division (ISD) anticipates the award of a purchase order on a sole source basis. This justification for other than full and open competition is submitted for approval in accordance with (IAW) Federal Acquisition Regulation (FAR) 6.303-1 (a) using the authority in FAR 6.302-l(b)(2)-only one responsible source and no other supplies or services will satisfy agency requirements.

BRIEF DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED, AND THE INTENDED USE.

The USCG, ALC, ISD has a requirement on a sole source basis for IBM Accelerated Value Program Software. Purchase of Nomenclature: Maintenance/support subscription for the IBM Accelerated Value Program Support for IBM Cognos Qty: 1 year Support from 1 Sep 2023 through 31 Aug 2024 The USCG utilizes this software to effectively develop, administer, and deliver IBM Cognos business intelligence for the ALMIS system.

UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER

SUPPLIES OR SERVICES CAN BE USED.

IBM Accelerated Value Software is a support service that is only available from IBM Business Machines Corporation. The USCG utilizes this software to ensure ALMIS users of Cognos software continue to receive necessary and timely support and maintenance in support of unit mission.

A DESCRIPTION OF EFFORTS MADE TO ENSURE THAT QUOTATIONS OR OFFERS ARE SOLICITED FROM AS MANY

POTENTIAL SOURCES AS PRACTICABLE (INCLUDE YOUR MARKET RESEARCH EFFORTS HERE).

Extensive market research was conducted using both Government and commercial sources. This included querying the following information systems and web sites: Defense Logistics Agency (DLA) Federal Logistics Information Service (WebFLIS);

Department of Defense Electronic Mall (DoD EMall); the General Services Administration's (GSA) on-line purchasing service- GSA Advantage!®; Inventory Locator Service e-marketplace (ILSmart); internet search engines; and the OEM's web site. These services are not available from any mandatory Government source IAW FAR 8.002 or from any non-mandatory source IAW

FAR 8.004.

REASON THAT SUGGESTED SOURCE IS THE ONLY SOURCE WHICH CAN PROVIDE THE SUPPLIES OR SERVICES.

As the owner of all proprietary rights to the IBM Accelerated Value Program Software, IBM Business Machines Corporation is the only one in possession of the data related to the software’s design and function. This information is required to service the hardware and make any changes to software code. This technical data is not owned by the Government nor is this information licensed to any other commercial sources.

EXPLAIN WHY AN ADEQUATE PURCHASE DESCRIPTION OR OTHER INFORMATION SUITABLE TO SOLICIT BY FULL

AND OPEN COMPETITION HAS NOT BEEN DEVELOPED OR ARE NOT AVAILABLE.

The Government does not own or possess any rights to the software code required to make any changes to the IBM Business Machines Corporation Accelerated Value Program Software. The development of the code required for the USCG to create a comparable information system has been deemed uneconomical. I In addition, it would be difficult to integrate historical measurements and other data into any new software so that long-term performance can be reported and analyzed.

PROVIDE A STATEMENT OF ACTIONS, IF ANY, THE GOVERNMENT MAY TAKE TO REMOVE OR OVERCOME ANY

BARRIERS TO COMPETITION BEFORE FUTURE ACQUISITIONS ARE REQUIRED.

As previously stated, the Government does not own or possess any rights to the software source code that is required in order modify the IBM Business Machines Corporation Accelerated Value Program Software. This has prevented the USCG from being able to provide an adequate technical description to potential new sources. It is difficult to take steps to foster competition when the necessary data is proprietary to the OEM.
