11a. Time of delivery.
Unless otherwise requested, deliveries will be shipped via UPS or Federal Express ground service for delivery three to five business days from date of shipment. There are no delivery guarantees for this service. Overnight and two-day services are available at an additional cost and are subject to the carrier’s published delivery time guarantee. In cities where same-day deliveries are available, Cellhire may use an in-house messenger or courier service.
11b. Expedited Delivery. Agencies are encouraged to contact Cellhire for the purpose of obtaining expedited delivery. Additional charges may apply for urgent & accelerated deliveries.
11c. Overnight and 2-day delivery. Please contact Cellhire.
11d. Urgent Requirements. When the Federal Supply Schedule contract delivery period does not meet the bona fide urgent delivery requirements of an ordering agency, agencies are encouraged, if time permits, to contact Cellhire for the purpose of obtaining accelerated delivery. Additional charges may apply for urgent and accelerated delivery.

Note: Commercially available products under this solicitation may be covered by the Energy Star or Electronic Product Environmental Assessment Tool (EPEAT) programs. For applicable products, offerors are encouraged to offer Energy Star-qualified products and EPEAT-registered products, at the Bronze level or higher. If offerors opt to offer Energy Star or Electronic Product Environmental Assessment Tool (EPEAT) products then they shall identify by model which products offered are Energy Star-qualified and EPEAT-registered, broken out by registration level of bronze, silver, or gold. 1. ACCEPTANCE TESTING
The Customer will accept the Equipment when delivered on or before the Delivery Time and if for any reason the Customer fails to accept the Equipment on or before such date the Customer shall nevertheless be liable for the stated Rental Charge in full.
The Contractor shall provide acceptance test plans and procedures for ordering activity approval. The Contractor shall perform acceptance testing of the systems for ordering activity approval in accordance with the approved test procedures.
2. EQUIPMENT
Cellhire shall make available wireless telephone devices. The cellular devices offered shall be compatible with the cellular access standards employed within the geographical scope of the contract.
The Contractor shall make available cellular voice and data devices. The cellular devices offered shall be compatible with the cellular access standards employed within the geographical scope of contract.
The Contractor shall provide programming of any cellular telephone device, including Contractor-provided and ordering activity-furnished devices, that conforms to the cellular service furnished by the Contractor.
3. WARRANTY
The Contractor shall provide a warranty covering each Contractor-provided device. The minimum duration of the warranty shall be the duration of the manufacturer’s commercial warranty for the item listed below:

a. The warranty shall commence when the equipment is delivered. Cellhire, by repair or replacement of the defective item, shall complete all warranty services within five working days of the notification of the defect. Warranty service shall be deemed complete when the user has possession of the repaired or replaced item. If Cellhire renders warranty service by replacement, the user shall return the defective item(s) to Cellhire as soon as possible, but no later than ten (10) working days after notification.
b. Cellhire warrants that the Equipment will be in working order when it is delivered to the Customer, but cannot be responsible for the performance of the Equipment or the operation of the telephone network to which it is connected, it being acknowledged by the Customer that Services may be temporarily interrupted (including dropped calls), delayed or otherwise limited due to a variety of causes, including without limitation transmission limitations and by atmospheric and other conditions, system capacity limitations and system and equipment failure.
c. CELLHIRE MAKES NO OTHER WARRANTIES, GUARANTEES OR REPRESENTATIONS, EITHER EXPRESSED OR IMPLIED, REGARDING ANY MATTER, INCLUDING WITHOUT LIMITATION, THE MERCHANT ABILITY, ACCURACY, RELIABILITY, CONDITION OR FITNESS FOR A PARTICULAR PURPOSE OF THE EQUIPMENT OR THE CELLULAR PHONE SERVICES FURNISHED UNDER THIS AGREEMENT. The Customer shall be solely responsible for and shall indemnify and hold harmless Cellhire against all claims, demands and liability arising as a result of lease, possession use, condition, operation or misuse of the Equipment or the cellular phone services provided hereunder. CELLHIRE WILL IN NO EVENT BE RESPONSIBLE NOR SHALL THE CUSTOMER MAKE ANY CLAIM AGAINST CELLHIRE FOR ANY LIABILITY, CLAIM, LOSS, INJURY, DAMAGE OR EXPENSE OF ANY KIND (INCLUDING LOST PROFITS) WHETHER DIRECT, INDIRECT OR CONSEQUENTIAL CAUSED BY THE EQUIPMENT OR THE FAILURE OF THE EQUIPMENT TO OPERATE CORRECTLY OR AT ALL OR DELAY, FAULTNESS (SUCH AS DEGRADATION OF SERVICE) OR FAILURE OF THESE SERVICES.
d. Cellhire reserves the right to deactivate the Equipment at any time and without notice to the Customer, in the event that Cellhire detects usually high usage or possible fraud in accordance with general operating practices and procedures in the cellular industry, and Cellhire shall have no liability whatsoever to the Customer for such deactivation.
The warranty shall commence upon the later of the following:
a. Activation of the user’s service
b. Installation/delivery of the equipment
The Contractor, by repair or replacement of the defective item, shall complete all warranty services within five working days of notification of the defect. Warranty service shall be deemed complete when the user has possession of the repaired or replaced item. If the Contractor renders warranty service by replacement, the user shall return the defective item(s) to the Contractor as soon as possible but not later than ten (10) working days after notification.
4. MANAGEMENT AND OPERATIONS PRICING
Cellhire shall provide management and operations pricing on a uniform basis. All management and operations requirements for which pricing elements are not specified shall be provided as part of the basic service.
5. TRAINING
Upon delivery to the Customer, Cellhire will provide an instructional leaflet on the use of the Equipment. Additional operating instructions for the latest wireless phone in the Cellhire fleet can be found on the Cellhire website at https://www.cellhire.com/rentals/support
6. MONTHLY REPORTS
In accordance with commercial practices, the Contractor may furnish the ordering activity/user with a monthly summary ordering activity report.

8. TRADE AGREEMENTS ACT
Although contracts awarded under this solicitation are subject to the Trade Agreements Act, Wireless Service under SIN 517312 is not covered by the World Trade Organization Government Procurement Agreement (WTO GPA) or any of the other Free Trade Agreement (FTA). See FAR 25.401 (b)(2).
